Timeline

What are the documents required for  AOS for a legal non immigrant married to a US citizen.

I ve read some immigration sites but I dont really know if u need taxes etc.

How soon can work permit be obtained.

You need the following forms for an AOS Package:

I-130, I-130A, I-485, I-765, I-131, I-864

 

Read those forms' instructions, and fill them out.

You will need six passport pictures of yourself, two passport pictures of your USC Spouse.

You need: your passport, your electronic I-94 obtained from the CBP website, your birth certificate (translated into English), spouse proof of US citizenship (birth certificate and/or passport), marriage certificate/license.

 

Start collecting evidence of a bona fide marriage. They are not required to be submitted with the AOS package, but will be needed at the interview.

 

Your work permit will be issued to you in approximately 90 days.

08/01/17 - Package delivered to CSC

08/05/17 - NOA1 received by US mail

08/10/18 - Rec'd new NOA1 with 18 month extension instead of 12 months

10/15/18 - Case transferred to Nebraska

12/26/18 - ROC Approved

That's what I was wondering also.... I'm assuming OP is in legal status in the US on a nonimmigrant visa

Came with a visa . :rolleyes:

I 130 is for illegal immigrants. I hope im right. Is affidavit of support and taxes necessary at this stage?

Okay. No I-130 is not for illegal immigrants you'll have to use it also.

 

Work permit is about 4 months right now.

 

Yes the Affidavit have to be sent in with the package along with evidence (tax returns and so on)

No, I-130 is not for illegal immigrants, you will need your US citizen spouse to file one on your behalf.

Just noticed your profile and it states you hold a K1 visa. If you hold a K visa, it's the only instance you are not required to submit an I-130.

 

The I-864 is the affidavit of support, yes it is necessary. So is the most recent tax return.
