You should be fine. The important thing is that he didn't have any drugs in his system when he had his medical

Lying can get you a permanent ban. There is also a big difference between saying that you use drugs and saying you tried something 15 years ago.

That is wrong. Yes, it is legal in a few states, but for the federal government it is illegal. There are a lot of people getting in trouble when they have to deal with the federal government, the executive branch especially. 

 

Plus, in the country where the fiance was it is illegal. 

 

OP, yes, I've read people were ask to wait a year to get their visa. They basically make you wait and do another medical. Someone mentioned this a week ago.

Normally a 1 year ban. If so, maybe it is best to file CR1 rather than K1, as once the ban is over he can have his green card straight. Did he submit the docs already? Maybe he can go to make a second medical at another hospital, hope that they will not ask him the same question and submit the new medical to the embassy during interview. Of course, he cant lie, so the slim hope is that they dont ask.

I am not sure if misrepresentation to a foreign doctor is the same as m.r. to an US officer. I think only the latter can bring you a ban, not the first.

It's misrepresentation on documents you use to get access to the US, it's not just lying to a foreign doctor. The medical report is made and used by USCIS, not the foreign doctor.

The results of the medical are forwarded to the consulate straight from the panel physician.
I highly doubt you can just swing to another clinic if the result doesn't please you, or if you screwed stuff like in this case. 

@Esme2504: Good luck for you both! Maybe he'll still pass if he didn't have anything in the system. Hope dies last!

Not in every country. My wife was handed them over and she had to bring the results to the Embassy, but was told not to open them.

So, I guess it depends on the country.
