my fiance and i have decided to do a prenup. we want to execute the prenup before i POE. fiance's lawyer will draft the prenup and send it to me. is it ok if i sign it while i am still in my home country and then send it back to him? is there anything special i need to do after signing the document to make it "valid" under US law?

 

anybody has any similar experience would be great to hear your experience. thank you and god bless!

Curious... If your fiance has a lawyer, how come the lawyer didn't already advise you guys on this?

That highly depends on your local embassy. The US embassy in the UK actually provides such service for all nationalities. Refer to your local embassy's website. They should have some info. Otherwise, contact them via e-mail to inquire.

oh cool, if its open to all nationalities (at least in the UK) then maybe it is open for my local embassy. i will check my local embassy. thanks.

Make sure to let them know that you want a prenup which would be used in the US to be notarized. I think they only notarize certain types of documents.

Since you do not have proper legal representation on your side, while executing the prenup, the prenup is probably invalid anyway.

 

Just keep that in mind for the future.

 

That is unless the prenup is important to you. In that case, lawyer up.

You need a your own lawyer to make sure you are protected in that prenup. Without your own attorney it will most likely be invalid in court.

Not having a lawyer does not make it invalid. It would be invalid, if there was some sort of coercion or it was signed under duress. People sign legal documents without the presence of a lawyer all the time. It should be common sense, if you read it and agree to it sign it. If you don't feel comfortable signing it, don't. 

 

I haven't renewed my notary in years, however if I recall right, it would be valid no matter where it is signed. I remember having to seal all documents that would leave the state I notarized it in. To be safe I sealed all documents. But as long as it is notarized and has the notary seal it shouldn't be an issue. 

 

@KULtoATL her attorney, could not advise him on anything at this point. He represents her.

Does not depend on the local Embassy.   All US Embassy consular sections offer notarization sevices to anyone/any nationality for documents to be used in the US.
