Hi all again,

My husband put his 2005 tax return ( we are trying to get from IRS his extension), my package had the list of poverty from 2006. We are in 2007. Which them will be valid in the valour: the guideline from 2007 - $17,11? or from 2006 - $16,500?

07/20/2006 I Married with my soulmate

I-130

11/08/2006 We sent I-130

11/10/2006 Nebraska received and sent it to California

11/15/2006 California received it

11/18/2006 NOA1

02/01/2007 Aproveeeeed!!!

12/02/2006 We sent I-129F

12/06/2006 they received it

12/11/2006 NOA1

12/15/2006 they moved our process to CSC

12/18/2006 CSC received it

02/01/2007 Aproveeeeeed!!!

02/15/2007 NVC signed our case number and sent to Rio Consulate

03/21/2007 We sent the packet 3

03/23/2007 Today we received the packet4 from Rio consulate

04/11/2007 Medical exame completed

04/16/2007 visa tax payed

04/24/2007 Interview - Visa Aproved

06/06/2007 POE!!!!!!!!!!!!! I cant wait to be with my husband!!!!!!!!

Second phase:

12/28/2007 AOS Sent

12/30/2007 AOS Received

01/04/2008 Notice Date

01/09/2008 Touch

01/23/2008 Biometric appointment (done)- They corrected my name ( I have 4 names and on the NOA they wrote just 3 names)

02/21/2008 EAD card ordered

02/26/2008 EAD card ordered (AGAIN???)

02/28/2008 EAD Aproved (it s very strange! did they order firstly and after aprove it????)

02/20/2008 interview letter sent (I just received it 5 days after the date)

03/03/2008 EAD card received

03/07/2008 SSN aplied

03/14/2008 SSN received

04/10/2008 Interview appointment - Aproveeeeeeed

04/15/2008 GC already ordered - Yahooooooooooooooooooo ooo ooooo!

What happens when the affidavit of support isn't examined for sufficiency until months or even years after it was submitted? The new rule clarifies that the adjudicating official must consider the sufficiency of the affidavit of support based on the income reported for the year the I-864 or I-864A was submitted, not on the sponsor's income on the date the application for adjustment of status or an immigrant visa is adjudicated. Similarly, adjudicators must use the federal poverty income guidelines in effect at the time the affidavit of support is submitted, not at the time it is considered for sufficiency. For that reason, all sponsors must submit Form I-864P, Poverty Guidelines, with the affidavit of support. In the event that more than one year has passed from the date of submission to the date of adjudication, USCIS or DOS officials may, in the exercise of discretion, request additional evidence, such as income tax returns for the most recent tax year. In those cases, it will be the sponsor's income and poverty income guidelines in effect for the year the adjustment or immigrant visa application is adjudicated that will control, not for the year the affidavit of support was originally submitted.

then they will accept Our I-134 with the valour above $16,500 and under $17,117?

The CO will want assurance that the information provided with the I-134, on which they are basing their decision, is current......2005 income taxes probably wont benefit you at all. Tax returns are not a requirement of the I-134 ,neither is meeting the 125% benchmark. The requirement is that the income be adequate. The assumption has been that because you will eventually to meet the that 125% level , it is in the best interest of the sponsor to be there from the start.It's been discussed( for the life of me I cant recall where) that meeting 100% income level is all that is required for the I-134 initially. A bank letter , employment letter and recent paystubs would be sufficient to establish the income level.

I have drawn the conclusion that being above the 100% but closer to the 125% level would be acceptable income......but thats my opinion. The 2006 125% level is still significantly higher than the 2007 100% level.

The difference in the 06/07 amounts is only $612.00......or $1836.00 for the 3 years required.........can you find some assets to make the difference?

A bank letter is unlikely to be sufficient to establish income level. Establishing income level is going to require some combination of employment letter, pay statements, and income tax returns (for those whose income is from employment).
