N400 form,page 14, quesiton 23: Have you ever be arrested, cited,detained by law enforcement officer for any reason? 

 

i wanted to ask, does the highway overspeed ticket(citation) count ? i got a ticket in 2013 on local highway for $130 penalty. I paid off next day online.

 

should i mention this on the form ?

if it is a must, then i wouldn't have big concern, since speedy ticket is such common in daily life. It's not a crime at least! the IO wouldn't care neither.

how about the street parking ticket ? my wife got this ticket(but not a citation) for $25 last year because of parking on street but blocking the fire hydrant spot.  

will this be mentioned on the form as well ?

it is a crime or else they would not give you a ticket but it is just an infraction which is below misdemeanor and felony.

 

I don't think you have to submit any paperwork for this. from the n400 instructions.

 

You do not need to submit documentation for traffic fines or incidents that did not involve an arrest or did not 
involve drugs or alcohol, if the only penalty was a fine of less than $500 or points on your driving record.

It's not common in my daily life!

 

It is a crime and the officer will be interested. Just because no one was injured or no property was damaged doesn't mean it is not a crime. The officer will be interested in your obvious disregard for the law.

If she is filing the N400 for herself as well, then yes it has to be mentioned on her form.  A ticket is a citation.

I checked the N-400 instructions and found them. Thus, if I have a speeding ticket for less than $500 I don't have to mention it in the N-400.

You DO have to mention it----you are not REQUIRED to show documentation for tickets less than $500.  Big difference.

The question asks have you ever been cited, (this is regardless of the amount of citation)....cited includes any and all traffic violations.  

 

Why take a chance on willful misrepresentation leading to denial over something so minor as one traffic ticket?

I think you are right, maybe I misunderstood the question, however, it's better to be safe than sorry

It is.  All you need to do for that ticket is bring proof that the fine was paid incase it is asked for.  If you have no proof of the fine being paid, get at least a printout of your driving record from the DMV.

 

Remember, you are not REQUIRED to show documentation for it, but you do have to mention it and it is possible that proof of payment can be requested by the IO even though the charge was under $500.  With traffic tickets, the IO will be more concerned that there are no outstanding fines.

 

With USCIS it is always better to be safe than sorry.  Your one traffic ticket is not going to be a big deal by mentioning it---however it can become a huge deal if you don't.

Last week, my interview was almost derailed because I mentioned I got a traffic citation in April 2017; and that I had paid the ticket, about $100.    The IO wanted to see documentation! I explained it was in another state and I did not have any documentation of paying the ticket.    He marked my interview paper, "could not make a decision today".  He then sent me to the waiting room while he checked with his supervisor.  He returned 5 minutes later and told me he would approve me and I didn't need to show any documentation.  He told me I was free to go but did not change the paper to "approved."  Bring documentation that you paid your tickets!

 

I also wondered why the background check did not reveal any citations for traffic tickets....

I think because in most cases, one is not fingerprinted/booked for traffic violations (unless dui, I would imagine).  In most cases, you get pulled over, receive the ticket and then just drive off.
