I've read in a few places that consular services Bangkok doesn't really like co-sponsorship of K-1 applications and typically will deny them, but also that exceptions made.  I have also read that many consular services sections look dimly on using assets to make us the entirety of the support.

 

My current situation is that I am attending graduate school full time, and expect to graduate in May, 2018.  I'm getting a technical degree and by job prospects are outstanding.  I am not currently working, nor have I for about 3 years.  I expect to be able to start work as soon as I graduate, and my fiance and I hope to get married around that time.

 

My fiance and I are just beginning the process (I am getting ready to file the I-129F, so getting the I-134 together is a ways off).

 

I have about $90,000 in stocks, and whole-life insurance with a cash surrender value of about $13,000.

 

I currently live with my parents while attending grad school, and they support me (I do not receive a stipend from the university).  They have graciously agreed to co-sponsor the application, and have ample resources to support the application.

 

[1] Should I anticipate any problem with approval under these circumstances?

 

[2] If I get a job offer before the visa interview, will having an offer letter help the situation?

 

[3] Should I explain all this is an addendum to the I-134?

 

If this belongs in a different forum, or some of questions have already been answered and eluded my search, please gently point me in the right direction.

  1. I don't know how strict the COs in Thailand specifically treat assets or co-sponsors for the I-134, sorry. The amount you have seems to exceed the requirements so I would at least be optimistic. But it's really up to the CO...they will look at the totality of the circumstances and make a decision about the public charge concern, which is the underlying requirement.
  2. No. They go by current income, not job offers or earning ability.
  3. I'm not sure what you're planning to explain...? The assets are the assets and you will need to present supporting documentation for them.

Hopefully somebody more familiar with the Bangkok embassy can chime in for a better idea on #1. You may want to report your thread and request that it gets moved to the Thailand regional forum as this is really a more embassy-specific question.

@geowrian has answered what you asked but I'd like to touch on the bolded part.

 

Have you actually filed a I-129F and received the NOA2 and proceeding to the K-1 stage at the local embassy? If you have, I don't think your graduation timeline would work with the K-1 validity just by counting the months. 

 

If you haven't already started on the process and you plan to get married in May or June 2018, then don't file just yet :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I haven't filed anything yet.

 

@KULtoATLWhy don't you think the timing would work?  I guess I figured on filing in the next week or so, about 7-8 months to obtain the visa, which would be valid for some time after issue.  I thought it was typically six months from the date of the physical, is that wrong?  Then 90 days to marry upon arrival.  Where have I got it wrong?

 

Also, once the embassy contacts to schedule the interview, isn't there some slack to delay that by a few weeks if the timing is tight?

Good points re: the timeline. I'll just note that you can usually delay the interview for up to a year from I-129F approval. Just make sure the embassy renews the I-129F so it doesn't expire (it's valid for 4 months initially)..they usually do this automatically but confirming it with the embassy would be prudent.

You're correct. I think she thought you already filed and got the NOA2.

 

The visa is valid for 6 months from the medical or the interview...whichever came first.

You can delay it quite a bit (see above). There's no requirement to apply for the K-1 or anything right away. haha

You are correct about BKK not accepting joint sponsors in most K 1 cases. To have a chance you will have to have a plan to get them to accept one by knowing how & when to submit some info that will satisfy them. That would include info about your educational status along with plan to begin a new life with your new partner. 

Stocks ect do no good. Assets must be liquid. 

# 1 Yes

# 2 Job offer wont hurt but may not mean much because its just what it appears to be. 

# 3 Wont hurt to try. There is no other chance to do so really.
