Filing for AOS for my new wife and step-son.  I have got them both listed in the i485, he is listed as her child.  I am filing a I131 as well.  Question is do I need to file a i131 for each of them or just one for her???

Definitely one set of forms each :) And separate payment for each person too.

it is with thier aos so it is free for both just include the noa1 if you are not filing them at the same time as the aos.

I know I-131 and I-765 are free if filed concurrently with AOS or by attaching the AOS' NOA1. I just meant each person will need to pay separate AOS fee :)

if the step child is under 14 years old the aos fee is lower. don't remember by how much but something to look into if the child qualfies.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

LOL.. OK you guys got me confused...   I filing both the 485 and 131 at the same time.  My step son came in with her on the original 129..    Why do I need to file AOS separately for each of them?  The $1140 fee is only for my new wife?  Do I have to include additional fees for the biometrics for her too or is the $1140 cover everything?

it is 1 i485 per person. the child's i485 is only $750 (please verify how much) and that is in addition to the mothers i485 and fees.

 

removal of conditions in 2 years will again require 2 separate applications since 2 people are involved.

 

immigration is not cheap. I have done the paperwork and fees for wife and step child too.

yep.

 

the i129 was just a petition to show relationship with the mother with the child listed as a derivative. now they are both here both need greencards and this requires both to have i485s filed. there is some overlapping information so they don't charge the whole amount. but there are enough differences that there is still work that needs to be done for both.

that will be together since the child's aos is dependent on the mothers being approved.

same package is fine just make sure they have thier own documents.
