We submitted our I-129 petition for finance visa in Nov 2016, the USCIS website has reviewed it two months ago and it's still waiting for clearance check to be completed. Does anyone know how long this takes? I am starting to think due to our nationalities that this is just a way they suspend people in order to prolong the process. I am thinking about canceling the petition

I am am a British citizen, Iranian born

finance is American citizen Syrian born

AP can take as much or as little time as it takes. Each case differs. Your US petitioner can ask her senator or congressperson to make an inquiry on behalf of her.

The US petitioner can write to USCIS to cancel the petition but if you guys are planning to file for a spousal visa thereafter, you'll have to wait from the start again and there's no guarantee that your AP would be shorter.

For my I-129F, K-1, AOS, EAD, AP and ROC detailed timelines, please refer to my timeline page :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

My sincerest gratitude to all VJers, especially the late geowrian.

Sis still with USCIS, you haven't had an interview yet?  That is definitely a delay on a K1. and yes, it likely has to do with your birth nationalities.

I'd recommend contacting your elected reps too and getting them to check up.  There is little point in canceling the petition and trying again/ getting married and petitioning for a CR-1 spousal visa, as the same thing will likely happen again.

It can take a year or longer, though that is extremely unusual, especially before interview.  Usually with security/ name checks, you get to the interview in the normal 5-6 months time frame and then get put in AP (Administrative Processing).  I am going to move your thread to the AP/ Waivers forum; while that is mostly for after-interview stuff, the experts there may have some good input.
