Let me get this straight, your ex-fiance petitioned you but things didn't work out so you are trying to find a way to withdraw yourself

or like many have said, wait a year until it expires. For me, this means your relationship just ended days or weeks ago, but somehow

you are already asking if this can affect your 2nd petition before your 1st expires.

If you can get engaged to two different USC within ONE year and somehow talk them into petitioning you right away, clearly you are meeting

USC for the sole purpose of migrating. I hope they outright reject you and put a ban on you.

Could have been a surprise to her as well, maybe she didn't know it was still active until she got the email from NVC to start application. Who knows but them.

The fact that petitioner seems bitter suggests he feels like he was "thrown back for a bigger fish". I hope that's not the case.

Hi everyone, I would like to ask if someone here have experienced our case.

Our case is ready for the medical and interview, however, it didn't work out between the two of us.

i have heard that the petitioner should send an email and call them, but my ex fiance doesn't wanna' do that.

if i will be the one to email them, will they acknowledge it? How long does it take to have that cancelled? Or should i just wait for the NOA 2 to expire by november?

Also, if ever someone will file for a petition for me again, can he file while our status is pending?

Will it affect our visa? Should we file for a fiance or better a marriage visa?

thank you so much for your help.

You may want to post this question on the FB site ( K-1 Group- Visa Journey) that way you can ask other Filipinas in Tagalog.

Here's another idea Ms. does BF#2 know about BF#1? If he does, would he be willing to return the filing fee that BF#1 paid in return for a formal withdrawal?

This is America "art of the deal" and all that. Think outside the box but inside the law.

The petition is going to be a problem even after it expires.  You should wait a while until the petitioner is in a better mood, and then ask him to withdraw the petition.  You can even write the withdrawal letter for him and email it to him.  That would make it easier for him.

Even after a year, if i decided to get married in my country and file for a marriage visa, it will still cause problems?

I have seen cases here on VJ where it was a big problem. In one case, the new petitioner contacted the previous petitioner and pleaded with him to withdraw his old petition.  The previous petitioner did so.  If I remember correctly, the old petition was several years old, had long ago passed its one-year expiration, but was still in the system.

Edit: I believe the beneficiary was denied at her first interview because of the old petition, and that's why the second petitioner contacted the first petitioner.

Oo ate it will cause serious scrutiny especially both are usc

I cant understand why it would be a problem after it expires. After a yr, without any action, that means both parties are not interested anymore.

The petitioner seems to be crazy, and doesnt wanna cancel it. But relationship doesnt work that way.

Also, if i am already married in the philippines after a yr, why would it cause denial? I mean, i cannot cancel it and things sometimes doesnt work out.

Does that mean, if someone filed for me at 1st, then it doesnt work out, and the petitioner doesnt wanna cancel it, so ill suffer for the rest of my life.

So after years, even if the petition had been withdrawn, there still had been problems for the new petition?

^this.

you totally took the words out of my mind as I read the OPs first post.

To the OP, I'm sorry that things did not work out for you and your fiance, idk how long ago you guys ended your relationship and I also don't know if you're still in the grieving stage of ending a relationship, but something sounds fishy that you are already looking to the future of trying to get another K1 (kind of sounds like you have something lined up already).

and with you saying "suffer" for the rest of your life. excuse me, I'm filipino, I was born in the Philippines but migrated legally to the United States with my family when I was two months old. I do have friends and relatives in the Philippines still and they are not suffering.

How are you suffering? Is there some law that you must marry a USC and immigrate to the US?

The problem is people take relationships involving immigration way too lightly. I know it is long distance and it is not easy to wait, but you still need time to know each other well before you take that big step in life.

Did fiance #1 end the relationship because "things didn't work out" or did you end it?

Either way you will need to find a way to get him to withdraw it.

I ended the relationship because he cheated on me and lied to me.

He is crazy enough to make me suffer and not cancel the visa.

I dont think time is a basis to know when you love someone. Time is not a measurement.

Some people known each other for a short time and are happily married.

Some known each other for long time and still get divorced

Sorry but I disagree. Also I was referring to LDR and relationships involving immigration. You need to have face to face time, in person. That is extremely difficult in these relationships. So you are saying that Fiance 1 is a liar and a cheat, but you also say that it would not be better to take more time to know this person before deciding to get married. Think about that.

I wish you luck, but like I said you will need to find a way to get him to withdraw his petition.

Sometimes, things doesnt work out.

The petitioner cheated and lied to me.

Idk if you would want to be with someone who will cheat and lie to you.

And also, i am thinking about the future. I didnt say i would file right away as in now.

And that suffer means he doesnt want me to be happy, cause he is crazy, and after treating me so bad , he still want me to continue the relationship.

I am.not suffering in the philippines cause i love our country. Its not about the country

Let's not jump to conclusions VJ fam. If He cheated the outrage should be on him and pitty for this poor woman. Love denied would be lifelong suffering no matter where you live, wouldn't we agree? I would seriously offer to pay back his filing fee for a formal withdrawal.
