Hi VJ people,

 

I have a dilemma and wanted your input. I requested expedite on my i129f due to DoD considerations (although I'm a contractor and not in the mil). I had the unit for which I work write a letter as well corroborating my story and also requesting expedite. I was eventually rejected, 3 weeks later.

 

My situation is this: I was sent the hard copy denial letter on July 27th, yet on July 28th I received an email response to an inquiry to make sure they received my supporting evidence. In the email, they said no documents had been received and I was to fax evidence as per instructions. How was I told one day that I had been rejected, then the next was told no evidence was ever received? It seems to me like I was rejected based on no evidence, but two Tier 2 officers told me otherwise without explaining how I could be sent an email. Therefore, I am wondering if I should re-try to expedite, because it appears to me none of my faxed documents ever reached the adjudicating officer of my expedite request. I don't want to bombard them with expedite requests at the risk of bringing suspicion to my case, however it really seems to me my evidence wasn't even looked at. Finally, according to a Tier 2 officer my case was 'pretty strong, certainly better than most of the requests we get.' 

 

I don't mind waiting if I have to, and can take a rejection, but it just seems like I was rejected without my evidence being examined. Can anyone chime in with ideas/advice?

Did you fax the documents in after receiving the July 28th notice? If so, call USCIS and confirm they received them this time.

Nope, because it said the decision was final and not up for appeal. I was sent a letter July 27th, yet online it says I was assigned an officer July 28th...

 

Also, I've called USCIS twice to talk to Tier 2 officers. The only confirmation I got is they are unable/unwilling to give any info. The second one told me to send a fax of a letter asking them to clarify how I was sent a letter before the case was apparently even adjudicated.

Ah so you were able to sign in? Did your case expedite info appear different from mine? Still trying to figure out if mine accepted or if I can't tell yet.

Yeah, it just says it was completed. There was no actual answer listed online.

I do not see the basis of an expedite, but I am not aware of any limits on how many you can request.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I didn't put that in my post due to the nature of the considerations and the fact I don't want to out myself. It wasn't the main point of my post either, just asking if this is normal or what. The Tier 2 officer himself seemed surprised it was denied, and said it was a strong case.

the norm is that you will know you have been expedited because your case is expedited.

 

If you are in the Military and get deployment orders that would be a reason to expedite, does not seem the case here.

I'm not sure what question you're trying to answer. I'm asking if it is normal to be told one day you were rejected, and the next that no documents were received (when they actually were sent). My conclusion from this is I was rejected due to lack of documents, and I wanted to know if someone else has other possible conclusions.

 

As for your other sentence, yes it would be A reason, but not the only one. I know of others who have used the DoD criterion who weren't themselves actual military personnel.
