so, my fiance sent in our k1 application last saturday which was the 5th of august and figured out the the name we put in our cheque was just US department  of home security instead of US department of homeland security. he called uscis customer service and says they will return our packet as soon as they recieved  it and see whats wrong. i just checked the tracking number and they already recieved our packet today but we havent heard anything from them (i know its too soon). so my fiance went to the bank to void the check instead of waiting for the papers to arrived. since we he made 3 copies of our documents  can we just send another one for our application?

If the problem with the application is the wrong name on the cheque, they cannot cash it and return the papers. If they cash it, it means they will continue with the application and the mistake was not big enough to prevent them from cashing it.

I wouldn't have voided the check. They wouldn't have cashed it - just sent back the forms asking for an updated check. In the off chance they do try to cash it, now it will be declined for lack of payment. Just wait for them to send the paperwork back and resend with an updated check.

Personally, I don't think they would return the papers for writing "Home" instead of "Homeland"........however, if he successfully voided the check before they cashed it, I think your only option is to send another copy of everything and an updated check because they WILL return everything for a lack of payment..........just my opinion....others might disagree....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

People answering phones are not USCIS officials making decisions. They have told dumb stuff to a lot of people on VJ and they have also told people the wrong thing. The person basically told you that if something is wrong they will return your package. He or she did not agree with you nor looked at your file. They have no information in front of them.

Not for nothing the USCIS hotline is also called the "misinformation hotline". THey also told everyone of the February filers that used the outdated forms that they were going to return their packages since they needed the new forms. Didn't happen. Everyone who was a few days over the expiry date still had their forms processed just fine without anyone having them get returned. I personally would've not voided the check but just waited it out to see whether they would still accept it.

It 100% does NOT matter what you put on that check. They WILL cash it and if the check has been cancelled the file will be returned to your fiance for lack of payment.

If you want to avoid delays DON'T cancel the check.

If you want to delay your process then canceling the perfectly good check WILL delay it for you.

Please listen to the members here.

If you he has already voided the check then you should wait until he gets the packet back.

Do not send another file until the old one is returned or he will just create more problems

You don't want 2 files in the system.
