Medical Exam & Affidavit of Support Question

Timeline

Hi All,

 

I just got the interview request in the mail last night and I have a few questions. Most things on the checklist looks kinda straight forward to me except a few things.

 

1) I completed the medical exam back in November 2016 for my K1 visa, I have the opened envelope that they gave me with all the vaccination stuff and I passed etc. Do I need to fill out the I-693 or have it transcribed by a USCIS approved doctor?

 

2) My wife filled out almost the same one for our K1, then again for the AOS package and nothing has changed. Does the I-864 have to be filled out AGAIN?

 

3) My wife hasn't gotten around to putting me as her beneficiary for her life insurance and my name isn't on the rental lease. We have a month to month right now with our awesome land lord (after a completed 1 year lease) and we'd like to keep it that way till we move out of this place. I'm also not on any of the utility bills since the ones we called basically said if he doesn't have enough credit he isn't getting on. My question is will it look weird if she puts me as a beneficiary like today? We were gonna do it anyways it's just been a busy 1.5 months since the wedding. Does it matter about the lease or utility bills?

1. If your DS-3025 is marked 'Complete', transcription is not needed. If you're missing shots, get them and then have a civil surgeon transcribe everything into a I-693.

 

2. Your wife still needs to complete the I-864.

 

3. No comment.

Timeline

1. If you didn't receive an RFE for the I-693, then you are in the clear. If your DS-3025 is properly filled in and marked complete and it is less than 1yr since you had it filled in, then that is all you need.

 

2. If your wife already filled out the I-864 and submitted it with the Adj of Status packet, then you do not need to submit again. I would just bring a copy of it with you to the interview. She did not fill out an I-864 for K1, that was an I-134 (IIRC). 

3. Now should be fine, it would have been better to do it a month or so ago, but it is not the end of the world. You could talk with your landlord about getting a letter from them saying you are a legal tenant on a month-to-month agreement, unless she is hiding you from the landlord or something. That would be better than having nothing. At the end of the day, if you have enough other evidence, then these won't matter.

Gave back her passport.-->03/31/2017-04/04/2017 - Case is being continuously touched. We suspect that our case was approved at this point but they didn't have her passport. --> 04/10/2017 (10 days after interview) - Email emabssy to inquire about updates and if there was anything we could do to move things forward. (3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

04/26/2017 - Checks mail, passport is there. No mention of it being mailed out. 

05/02/2017 - Arrives in the USA, without Issue

06/17/2017 - Marriage!

AOS

7/01/17- Mailed AOS packet to Chicago

7/03/17- Packet received

07/07/17 - SMS and Email notification of NOA1 for AoS, EAD, and AP

07/13/17 - Received paper copies of NOA1 for AoS, EAD, and AP

07/21/17 - Received Biometrics Appointment Letter

08/02/17 - Biometrics Appointment Completed 

11/04/17 - EAD Approved - New Card Is Ready For Production

11/09/17 - AP Approved, EAD - Card Produced Awaiting Mailing, EAD - Card Has Been Mailed.

1. I didn't receive a RFE for the I-693 so I guess I'm good to go there. 

2. She did fill it out already and we sent that in. Now I'm really confused since I've gotten different answers from searches and the forum. I may just get her to do it again juuustt in case.

3. K that sounds good, we had already talked about it, things have just been busy. I'll see what my landlord has to say about that one. He knows I'm here and I pay an extra $100 a month so I'm definitely not hidden. I think we have enough evidence just want to make sure it's all good. We have a joint bank account with a decent amount savings in it. I'm on the family plan with her and my sister/bro/mother in law as far as cellphones go. We had 2 weddings: 1 legal one before the big family/friends Ceremonial wedding. We did that so I could help with the big Ceremonial wedding plans and get settled in/do the visa paper work before our really big day. The big Ceremonial wedding happened 2 months later and we have all the documentation/pictures etc for it. We went on a mini moon and I have the pics and itinerary to prove that. I'm also on her car insurance and medical plan as well. Plus even before all of that I can bring my K1 binder that shows our 13 trips to see each other over the 2 years before I moved to the US. I'd like to think this is a slam dunk but I try to NEVER underestimate anything.

1. Yep, there is an outside chance that they will give you and RFE at the interview, but that's not a big deal.

 

2. Better safe than sorry I guess.

 

3. Sounds like a solid amount of evidence. I think the letter from the landlord would be acceptable and would be the icing on the cake to make this an absolute slam dunk (not critical though because your evidence does sound good).
