3 Yrs Tax Info- Below guideline for 1 year.. Matters??

I am getting my documents ready for my fiance K1 interview.

I have 1 child and I am above poverty level for 2004-2005, however for 2003 I only made 11,000 (full time student), I am concerned if this would cause problems, does anyone know if all 3 years have to be over poverty guidelines. I make well over now... :help:

2/1/2010- AOS , EAD. AP Mailed via USPS priority mail

2/3/2010- Received - via USPS delivery tracking

2/9/2010- Check Cashed

2/9/2010- NOA 1 Received for 131, 765, 485

2/17/2010- Received letter for biometrics

2/19/2010- Completed biometrics via early "walk in'

2/22/2010- Touched on I-765, 48

2/24/2010- Case transferred to CSC

4/2/2010 Card Production Ordered for I-765, AP touched (Yea!!)

4/8/10- Approval notice for I-765 sent via email/ AP touched

4/10/2010 Received AP.

4/12/10 Received EAD-

7/6/10 Contacted USCIS because now Outside normal processing time

7/23/10 Got RFE asking for proof of legitimate marriage- 1page and 1/4 of proofs

8/23/10 sent off RFE response via Expressmail

8/24/10 Received by CSC

9/2/10 Email from USCIS- Card Production Ordered

HI! This situation happened to me also. For one year I was below the poverty level because I moved from one state to another and lived with my family while I first of all took a break, then looked for employment. It put me under the poverty level that year. My "Sponsorship" was rejected because of that..................

My daughter is in the AirForce and makes plenty of income, but she was shy that one year also (because of the same reason as me.....) With our combined incomes they still denied us as sponsors.

I finally bent my pride.... and asked my parents who gladly Co-sponsered my 'Immigrant husband'.

With their affidavits and w-2 forms and whatever else was needed.... I finally qualified as a Sponsor, and my parents as co-sponsors.

I would immediatly IF NOT SOONER line up a C0-Sponsor. You are still considered the main Sponsor, but if they are still as strict as they were for me, you WILL NEED A CO-SPONSOR>

I do not feel so alone now, seems like some of us have a very similar financial situation. When this worried me last week I had my lawyer address this specific concern. Apparently, only the last tax return is looked at in the interview, and if you are above, then there should not be any worries....but i am a worrier, so, I read up on all that i can, just to be ready.

Ummmm......

ALL 3 years of my tax returns had to show ABOVE poverty level.... I dont know if they were just trying to pick on me or what, but at our filing of our AOS and at the actual interview, we were rejected the first time, and told we had an extended date to come up with a Co-Sponsor or my husband had to leave the country due to deportation proceedings that would be started against him.

BE PREPARED..... I dont know why in the world your LAWYER would tell you such a thing?

That is interesting, there seems to be varying standards at the consulates. I will persue this with my lawyer again. But, there is also the rule of 5 times the difference of income that one might be short of the minimum. If you have assets that be readily turned into cash for this amount, then that is allowed to qualify for support. So, Bandita, i bet you came up with a co-sponsor!

Bandita,

Are you referring to the I-134 at interview stage or the I-864 at adjustment of status....two different kettles of fish.

Just to note....Only the most recent tax return is now needed with the I-864 for adjustment of status.

There seems to be some confusion in this thread with the I-134 and I-864, and, the consulate interview and references to interview for adjusment of status.

The I-134 in most cases is used when an applicant is applying for a K visa to assist the Conof in determining if the applicant will or wont become a public charge. The I-134 is only one thing that a Conof will look at in determining such. Each consulate is different and each Conof conducting the interview will make an assessment based on the individual applicants circumstances. So whilst the requirements for the I-134 are for one years tax returns and 100% of the poverty guidelines there is occasion when 3 years can be needed and meeting the 125% of the poverty guidelines also needed. K visas whilst non-immigrant visas are processed in many ways as an immigrant visa.

The I-864 is used for immigrant visas and at Adjustment of Status.

Unfortunatley for me a sponsor is not available, but I am hearing the Jamaica service center dont really scrutinize all 3 years, so I wil pray and hope for the best...

I also hope an unofficial copy of my W2'S is enough

Hi everyone.. I dug this thread up from a while back. It states that many consulates do look at all 3 years to determine whether a co-sponsor will work. But the website that meauxna had me visit had an imigration lawyer stating that its not really a problem if one year is below as long as more evidence is provided. DId you guys provide such evidence, letter from employer, pay stubs, etc? I really wish there was more clarification on this subject.

I would be going by the link you were provided in that other thread. :yes: There is no connection with the tax returns and the poverty guideline one has to meet. Pay slips and letter of employment is evidence submitted to show that one meets the poverty guidelines.
