Keep in mind that you illegally overstayed previously. You also admittedly illegally worked while here (all of which might have been better to post originally). That shows extreme disregard and respect for our county's laws. Put that in your mind when it comes to applying for any other type of visa because those things will be in the mind of the person deciding whether or not to grant you one. If your wish is only to see your mother I think she will have to come to you.

You're unlikely to receive any kind of US visa anytime soon. Perhaps in a few years (5-6+) but it wouldn't surprise me if you were never granted one again.

Another factor that will give you difficulty in getting a tourist visa again (if you go that route) will be that you were jailed for unpaid traffic tickets when here (I'm assuming this happened in the States since you have yet to say otherwise).

 

Honestly, it's best in your situation, I think, to wait for the GC to go through (if you get approved for a GC), or have your mother travel to see you.

Is there a reason why your USC mother---or more specifically the USC brother you haven't seen in ten years since you said that hurt you more---can't travel to visit you?

It seems to me that your mom overstayed on a visit to the USA and that your first visa was issued with you not listing your mom as the person to visit. Eventually you were asked and you said your mom and they then realized she overstayed hence they cancelled your visa and issued a 10 year ban because you obtained your visa by offering fradulent info. Just my inference from the lack of some pertinent info.

 

You are a non US citizen or resident and as such have no legal claim to sue. A visa is not a right and as such they choose not to issue one to you. You can't then run and cry fowl because you or your mom withheld info or misrepresented. All you can do is wait out the years of the petition that your mom as filed or both of you visit in other country or she visits in your country.

no, your chance of getting a non-immigrant visa is ZERO based on the fact you overstayed, worked illegally and potentially lied about your mother being here!  let me repeat this, nothing you can do will change the fact that you did those things. no officer will issue you a visa. 

overstaying 8 months and working illegally is not a mistake.  you can wait for an immigrant visa but no IO is going to give you a tourist visa! go ahead and donate another $160 to USCIS. afterall, i know they can use the money.

Thiago - this may sound over simplistic.  but if you have a job paying very well and been working in it for at least 2 years and travelled to other countries in the past 5 years then you have some small chance - give it a shot.

I highly doubt they would get approved.  This person overstayed on the first visa, then committed immigration fraud when trying to get a second visa by not admitting to the overstay, received a 10-year ban from the US, and worked illegally, and has committed numerous traffic violations while here illegally, then had their licence suspended and was jailed for not paying the outstanding traffic fines.

 

I really think the chances of getting approved the third time around is 0, since the intent to overstay/lie to immigration officers has already been shown in the past more than once....having a good job in their home country isn't going to sway immigration at this point in time.

 

It's better if the OP just waits to see if the GC is approved or not.

Well he has a small chance if he did very well in the 10 years ban... let him try so he knows.

 

I didn't do any illegal stuff but my combination of having an immigration application and few so called red flags including a terrible interview for B1/B2 to replace a damaged visa which meant I was interviewed by more than one officer and in the end declined.

 

 

I was told by most to not bother trying again - I did about 10 months later and I did get the B1/B2, I just explained what needed explaining.

 

Same with my green card - had an issue that I won't discuss now but was told that my visa may never happen but it came through and rather easily.

Thanks everyone for the words of encouragement.

Im gonna continue to pray to God and ask for his direction in this matter.

I think I have a plan for prooving that Im well stablished here in Brazil financially and maybe the officer will have make his decision based on the fact that he knows that im the most benefited by not staying in America illegally again when taking my GC process that is underway.

Regarding my financial state:

I own a business here in Brazil. Im a fish broker.

Since my american step fater is in the fishing business I received help from him and started a business here.

I also work with comercial fishing boats so those constitute a pretty solid tie to this country.

I also represent other fish companies in different export/import deals so they can give a letter stating how much money I make off comissions on those deals every month.

Maybe the officer will accept those as ties too.
