After 15 months' waiting, senator told us we had RFE that we have never received

I think from some other posts i've read, RFE seems to have up to 90 days to respond. And if USCIS treats it as a no-response therefore ground for denial they'd usually update your online status as well. See this post here back in 2013: 

USCIS has made similar mistakes before, and I haven't seen anyone saying that they can just refile once it's past the required response period. Once it's denied, the case is closed. You might want to prepare for speaking to an attorney---you may need to file a motion with the immigration court (not sure if this is what the court is called) to have the case reopened.

 

This is unacceptable.. but then again, this administration is not favoring us immigrants.

 

 

This case freaked me out :-( But thank you for bring it to our attention. I just submitted the ombudsman request and am looking for an attorney.

Thanks everyone for the advice and sharing the experience. We greatly appreciate that. My husband is in military and he would also contact the immigration service on the base. The senator's office has been following up on our case and we'll let them know our concern about the case getting denied under abandonment.

One thing to add is that the senator's letter has a receipt number for the RFE. I entered it at the USCIS case status but the system couldn't find any record. My I-751 case number still shows "case was received" (also took a screenshot just in case).

This is interesting. I started receiving scanned images on May 8th (I believed I subscribed on May 6th, Saturday). Do you mean I probably only received the partial image of the mail?

I wouldn't say "partial", just delayed. At a particular time each day (which can vary from region to region), things transition over to the following delivery date and the systems start collecting images for enrolled users (adding new ones and removing unenrolled ones). If you miss that cutoff, it won't start collecting any new images until the following business day. That collection occurs throughout the night and next morning as workers process the mail and get it to the trucks. Then when they finish, we can generate a dashboard for a user and start sending emails (if opted in). So images can be delaye dby 1 day, but the first dashboard you see with mail would really be 2 days later. i.e. (all times are for example only)

May 6th @ 4 PM: User enrolls for ID

May 7th @ 2 PM (example cutoff time): System sees new user and starts collecting images for the user

May 7th from night -> May 8th ~7-8 AM: Collection of images

May 8th around 7-8 AM: Dashboard is available to user

May 8th around 8-9 AM: Emails sent

That sounds cool! Thank you and USPS for this great new service (and it's FREE). 

I should say I started receiving the scanned images on May 8th (Monday) and my "RFE" (if it exists) was said to be drafted on May 5th (Friday). It usually took 3+ days to arrive at my house based on previous experience.

Yesterday I received the update from the previous USCIS service request:

Recently, you contacted us about the status of your Form I-751, Petition to Remove Conditions on Residence, filed on May 16th, 2016.  On March 30th, 2017, you also filed a Form N-400, Application for Naturalization.  Our records indicate that your Form I-751 and Form N-400 are currently pending and will be adjudicated at the same time. 

 

Still they did not mention RFE. I am confused now.

No, I did not. My case does not have RFE at all.

That's a miscommunication between USCIS and the senate's office.
