AUGUST 2017 AOS Fillers (merged)

Hi All, I received an RFE and I'm trying to figure out how to correct it. I sent with my I-864 copies of my tax transcripts, copies of my W-2, an employment offer letter and copies of my pay-stubs where it shows my current salary. My annual salary is higher than the poverty line required, but last year I worked 6 months due to school and ended up with a low income. By the end of this year my income will be a little be under the poverty line based on my household size, and that is due to a change of salary that took place by the middle of the year. Maybe I should request another letter for immigration purposes to my employer where they shows my current annual salary which is above the poverty line for the household.

 

They are now requesting copies of my taxes with all supporting documents that I sent to the IRS, I filed my taxes electronically and I thought that it will be enough to send tax transcripts for the past 3 years.

 

Can I have anyone as the joint sponsor, even if they are not related to me, like a friend or do the join sponsor has to be a family member?

 

Also, could it be too late to remove dependents from the I-864, I included my husband's children who are not yet here, we were thinking of bringing them within 6 months and for that reason added them to the I-864, but if it is not too late and I could remove them from the I-864, we could try to bring them at a later time. That way I will not need a join sponsor.

 

What do you guys suggest?

My wife did the fingerprint today. Appointment was at 11am. We got there at 10:40am and was done at 11am. Pretty fast process. Like what some people said, make sure you bring your copy of marriage certificate if your last name is different than your passport.

Can you supply the tax documents they are asking you? I know you said you filed your taxes electronically but you can still print them and give them what they are asking. 

 

I am not sure you can change your household size now and remove your step children. Why did you add them when they are not in the US yet? 

 

You said your annual income at the end of the year will be a little below the poverty line so I suggest you look for a joint co sponsor. Anybody can do it as long as they sign the form and provide the necessary documents.

Hey all. Late-August AoS filer (received by USCIS August 29th) but only posting now. Originally came over on a K1 and got married to my lovely wife. All the fees were accepted for the AoS and EAD. Just had my Biometrics appointment today in Laurance, MA.

 

Two questions I’m curious about if anyone can help:

 

1) My wife and I are moving to a new apartment mid-October. Should I send USCIS a change of address notification now, or when we begin the moving process.

 

2) Now that I’ve done Biometrics for the AoS and EAD, how long should it take to get an update on either of these?

I make about close to $40,000/ year and Last year I made over $30,000 the year before that I was in school, I didn't make much. I'm trying to find out what the poverty line because I don't understand it all.

So total number would be 2 (including yourself). 125% of the poverty level in the 48 contiguous states is $20,300. What evidence did you send with the I-864? Tax returns, pay stubs, bank statement, employer letter? 

 

That fact that you got an RFE for this worries me too because I'm in a similar financial situation as you (I was a student not long ago).

I got a RFIE not even RFE, I did pay stub, work verification not employer letter and tax returns will send everything again plus more tomorrow morning.

is it ok to submit these forms in ink? I know it's possible but someone Mentioned to me some forms come with barcoded but any instructions I've rEad for all the forms says they can be completed in black ink. Is there any that I am specifically required to fill out electronically? Also someone mentioned something about an nvc letter with a bar code which form is that? 

Also also,  for my affidavit of support I don't currently meet the poverty line so I'm only sending 2 past tax transcripts and 2 w2s along with a letter of my current  employment but I don't have any paystubs for this job since I get direct deposit and our pay stubs are online, but I have a cosponsor who can provide her pay stubs and tax transcripts etc. Is that ok for my part or should I still present more info on my own behalf?

When you receive the biometric letter, does your case status online show the date? How long does it take to receive the appointment? I was under the impression it was pretty quick and since the NAO1 I haven't received anything :(

The case status online doesn't show the date of the biometrics appointment. From what I have noticed the majority of people receive the appointment notice around 3 weeks after NOA1, but I have seen people receiving theirs up to 2 months after (but it concerned very few people).

1) I think you should wait until you begin the moving process (a few days before the actual move), and also check your status online regularly to see if the USCIS didn't send you anything in the meantime.

2) Concerning the AOS, it really depends on your local field office, for some it could take up to a year to get an interview, and for some just 2 months after filing. As for the EAD, you should receive an update sometime between 75 days and 100 days after NOA1/PD (the USCIS website recommends to submit an SR if you don't get news about the EAD/AP in the normal processing time, after 75 days). From what I have read in the different threads, people receive their EAD/AP around 100-110 days after NOA1 at the moment.
