Anyone here has experience on below problem please advise me how I can deal with it.

 

I sent AOS package (I130, I485, I131 and I765) in Oct and well received emails with receipt numbers for 4 forms. However, I only have received 3 NOA1 (I130, I485 and I765) by paper and still lacking of NOA paper for I131. I called to USCIS yesterday for asking help, but one lady said that I need to check with USPS as they already sent 4 NOAs on the same day and cannot send duplicate. 

 

I am a bit worried what I need to do right now. Hope to have your useful advice.

AOS TIMELINE

 

10/18/17: package (I130, I485, I131, I765) sent by UPS

10/20/17: package received

PD for I130/I131/I765: 10/20/17

PD for I485: 10/30/17

10/31/17: 4 email notifications received 

11/04/17: NOA1 received (I130, I485, I765) [11/16/17: sent SR to ask for NOA of I131_pending]

11/10/17: biometrics appointment letter for I765 received

11/22/17: biometrics appointment for I765/DONE

12/08/17: biometrics appointment letter for I485 received

12/18/17: received courtesy letter

12/22/17: biometrics appointment for I485/DONE

01/05/18: Notice for EAD approved on 01/02/18

01/10/18: received EAD card

01/11/18: received SSN

Just make sure it is well kept within you when you go out. You can have both original and photocopy with you. Although, I have never heard of anyone being sent to jail for failure to carry their GC with them. But the America of the present day is capable of anything; once it is embedded in the law, sometimes it can be hard to contest. Others on this forum might have a different opinion.

First thing, contact your local USPS center and complain immediately. Sometimes, they leave some mails behind by accident, sometimes they drop mails in someone else's mail box. USPS do mix up mails, it has happened to my family multiple times.  Please do that today. If that yields nothing, then contact USCIS again and explain the situation, but make sure you speak with an officer that will give you meaningful solution to the situation. Hope that helps

Not carrying the GC on you at all times is actually a misdemeanor. No other status requires you to carry the ID at all times (e.g. F1 or H1B) -- but if you're a permanent resident, TECHNICALLY the LAW states that you have to carry the green card ALL THE TIME. 

 

I don't know if people actually do this or if they get stopped and charged for breaking the law if they don't have it. Where you live is probably a big factor.

Yeah  it remain  mystery  cause am scared  of losing  my stuff its had to replace  it.

White immigrants are probably able to go about without carrying the GC without much risk. It's likely a much bigger issue for immigrants of color, especially in states where there's a lot of racial profiling (e.g. Arizona had a lot of this in the news last year or so...).

The best is to carry a State ID or Driver's License because if you lose them you can get a duplicate one for a small fee at your local BMV but if you lose your GC or EAD/AP its gonna take a looooooooong time. Nobody knows about "waiting" than AOS applicants so I guess we can keep the GC at home or even at bank locker. With the reg number on State ID or Driver's License the police can know your immigrant status.

Didn't know about the LAW...

But from what I've read here it actually takes a lot of time to get a replacement card

I called the USCIS customer service center today and they said that even talking to a Tier 2 officer was done for the day because there are too many backlogs :( So now I have to wait until Monday to ask about my i-485...

 

They put in a service request for the AP at least :(

The law states that you should carry your PR card with you at all times.

 

However, I dont think I have ever seen this enforced ever. 

 

Usually carrying a driver license or state id is enough to prove legal presence. 

 

However, if you cross an international border you will need your PR card and it should be on you when crossing.

Yeah. I thought about it what I would do is copied my GC and EAD carry that with me along with my State ID, the good thing is that if you are stopped you can show them original docs in maybe less than an hour.

See below. But this isn't really an issue to be concerned with right now, we don't even have our green cards :D

  • If you are 18 or older, you do have to carry your green card with you. Section 264(e) of the Immigration and Nationality Act (I.N.A.) requires all lawful permanent residents (LPRs) to have “at all times” official evidence of LPR status. Failing to have your green card with you is a misdemeanor and if you are found guilty you can be fined up to $100 and put in jail for up to 30 days. (I.N.A. Section 264(e).) A copy is not good enough, because the law does not use the word “copy” or refer to “other evidence” of LPR status.
