We spoke with a Tier 2 officer when the RFIE was issued, and he had suggested that we could request another AP expedite immediately after USCIS receives the 485 RFIE response. I'm afraid to do that - or anything else - because I don't want to accidentally slow down the process. 

 

 

Yes after my RFIE was issued, I immediately sent it back overnight FedEx, once I received the case update from USCIS website that they received my evidence. I contacted my Senator to ask for an inquiry into my i765 and then reached out to Ombudsman. You can ask Ombudsman for expedited assistance if you are encountering some difficulty like job loss. It takes about 3-5 days for them to update case status after you send the RFIE to them, but assuming all is good with it I think you will get your EAD in about 3 weeks time. I also think Ombudsman helps a lot here as well.

Thanks! Had you contacted the Ombudsman before getting the RFIE too? I might do that tomorrow then. Did you also submit an expedite request after they received the RFIE evidence?

 

Also, you said you sent the response back on Feb 1 - is that the date USCIS received it? My response was delivered Feb 12 and they updated their system to say it was received on Feb 14. 

 

edit: forgot to say, congrats on finally getting to this stage! It's been such an arduous process I really can't wait for it to be over.

I contacted Ombudsman originally on January 12th and I think it was the Ombudsman who kinda pushed USCIS to really start processing my case. Ombudsman didn't receive a response from USCIS originally but they followed up again on February 16th and shortly afterwards my card was in production. I decided not to expedite the request because I originally expedited back in December and when I spoke to T2 officer he said I shouldn't expedite again. 

 

And yes, February 1st is the date that USCIS said the received my RFIE and will begin processing my case again. If your's was updated on February 14, I would say reach out to your Ombudsman and give it two more weeks. Hope you'll get yours soon, I think it should be in good shape if the RFIE was a simple request.

Do you have any tips on what to say to the Ombudsman? (This is done through a DHS-7001 form online, right?). I'm worried they'll say something like "you can't expect your EAD/AP any time soon because of the recent RFIE".

Yes, you fill out the form first, and then they'll send you an email and give you a ticket number. You can email them directly and ask for expedited assistance on your ticket number stating some hardship or why you want expedited assistance. I don't think you'll get any response such as that though however, I believe the Ombudsman just assists you with the processing of the case to get it "resolved". Resolved meaning to have your EAD produced or if it cannot be at least find a reason why it wouldn't be. The RFIE on the i485 shouldn't reset your clock. My Senator reached out to USCIS and USCIS informed us that the RFIE on the i485 only puts a hold on the EAD until they receive the RFIE. I think in your case the EAD is just awaiting getting assigned to an officer.

Thanks SO much for all this info, and for letting me interrogate you, lol. I feel a bit more hopeful... I desperately need my AP to travel in April, and this has been a nightmare come true.

Hey fam, I just received news about my EAD... a request for additional evidence o_O

 

Today is day 201 for me and I have NO IDEA of what this RFE on the I-765 only could be?! :/ take into consideration that uscis initially lost my form I-765 for almost 3 months and later they found it... I would be kind of upset it’s going to be a biometrics appointment but we will see, I haven’t received anything on the mail yet, just status update.

 

at least this means more people here will have updates on their status and things are moving, not so good for me though lol of course 

Timeline (From B2 visa to AOS)


July 15, 2016 -> Got married
August 3, 2017 -> Mailed AOS packet (I-130, I-485, I-765)
August 4, 2017 -> Package received
August 14, 2017 -> NOA for I-130 and I-485 (not I-765... called multiple times to ask about this but was told to wait)
August 25, 2017 -> NOA for Biometrics Appt (I-485)
August 30, 2017 -> Sent email asking to look for I-765 (My I-765 was LOST)
September 8, 2017 -> Biometrics Appt for I-485
September 26, 2017 -> Received email from USCIS I-765 found and PD August 4
October, 2017 -> NOA for I-765 and Tier 2 officer cancelled 2nd biometrics

November 3, 2017 -> Raised SR online for I-765

December 11, 2017 -> SR showed as "completed" by the assigned officer

January 8, 2018 -> Name was updated 

January 18, 2018 -> interview scheduled

Oh god, what the hell?? I would really recommend calling and asking to speak to a Tier 2 officer to find out what the RFE is about. Is it an RFE or RFIE? 

 

The Tier 1 officer will tell you that the Tier 2 officer doesn't have access to what is contained in the letter, and that you just have to wait for the mail. That isn't true. The Tier 2 officer will be able to see the exact letter and tell you what you need to do. 

 

I did this and it kept me sane while waiting for the actual RFIE letter to arrive in the mail.

I’m almost 100% positive it’s going to be “we need your fingerprints” because after I received a second biometrics appointment they (well, a tier 2 officer) told me they would use the same I-485 fingerprints and I didn’t need to go to do my fingerprints for a second time (it’s a 3 hour drive) but we know uscis can miscommunicate and I have the feeling they still needed the fingerprints and I shouldn’t have listened to that advice lol 

 

The other thing could be more evidence about me living/working in multiple countries for the last years but you would think this would be more on the I-485 side, right? Hm. Well hopefully it’s something simple... how long it takes after sending what they need to get things back to normal? 2 weeks?

From my experience and everything I've read on this site, it seems like it takes 2-3 days for them to update their site saying they've received the response and will resume working on the case. 2-3 days after the package is delivered there, I mean.

isn't your interview this coming week? If all goes well you will walk out as a PR.. and then the GC would come in a couple of days after... you wont be using that EAD! :)

It was supposed to be tomorrow but it was cancelled due to overbooked appointments and I haven’t received any reschedule yet, they said it could take a couple of extra months. So I really need that EAD since this has been the most unpredictable process I’ve ever been in, lol.    My good vibes goes for your parents’ EADs as well. May everyone receive some light soon!

Hey @Hamilton sorry for not being here. I did read that once someone receives their RFIE then the EAD/AP processing time starts again from day 1, which in my case was not true. I thought once I send in my RFIE response then I should wait for another 75+ days to receive my EAD or starts raising more SR's but to be surprise you know what happened !

I called USCIS today, and I can answer your question. I asked the officer or stated to me that the EAD processing is not affected if an RFIE is sent to the applicant. They are two separate applications. Hope that helps.
