She is a legal guardian and has a court document for it and she can sign it but in the instructions it says if you are under 14 years of age....but her nephew is 17 years of age now we dont know if he can sign or my wife should sign

@Aviinashh please try an speak with an immigration lawyer - yes it is quiet confusing.  I was thinking that her nephew is not under 14 years old - but he is still a minor in the eyes of USCIS - as long as she has legal documents saying that she is the guardian - I would like to think that she can sign on his behalf - but what do I know - consult a lawyer on this matter - so that they can better advised you.

I don't think oso because they have asked for only specific documents.

if over 14 the individual should sign. that's what the instructions say.

I am still in disbelief y'all I'm scared to start jumping for joy so I'll call them tomorrow just to see if I can hear this info myself my case online is still showing as received. @Aviinashh I'm in disbelief that they'd give you an RFIE after waiting so many months I've included you and all other August filers still waiting for EAD in my prayers when I can I wish i could address your questions but affidavit of support isn't my strongest point just Google and try to narrow your search or tailor it as much as possible to your situation and hopefully you'll come across results that'll work for you that's what works for me

Make sure you ask to get a tracking number and talk to tier 2...I got my approval notice yesterday and when I call the recording and first line of people don't see my approval. The lady was telling me to wait 60 days, and if I didn't receive the card within that time to call back, because she couldn't see the card being produced. I reminded her she also couldn't see my approval and I still was approved so I would like to talk to a tier 2 to double check and inquire about a tracking number, she was speechless for a minute and then apologized for not being able to help me and that she was going to transfer me but there was quite a wait...I got a call back within 2h and my tracking number.

Right now we have sent in all 3  SSA-1099s statements with AOS and now the total household income is $40,000+..Now my question is

1. When they accepted her SS and her nephew's SS combined annual income for I-134, will they accept the same now as well for I-864?

2. The nephew am talking about is 17 years of age and so he cant sign I-864A..what do I do? (they requested for his I-864A in RFIE)

 

One mistake what we have done is, for I-134 she directly said her total income is $29,000 and sent the SSA-1099's and got approved but now she has individually mentioned incomes as seperate as they asked for household income..so in her income she put $XXXX, nephew's income as $XXXXXX and father-in-law's income as $XXXXXX and we already sent in father-inlaw's I-864A but didnt send in the nephew's I-864A as we thought it comes under her income as she's a representative payee...

 

On the instructions page this is what I saw..

Hey Aviinashh, honestly, I really don't know what to say. This is just sad and sad. It's unbelievable that these people withheld your file for so long, only to come around and demand for more information. This is what I'd say to you: 

Before you send any document, it wont be a bad idea to let an immigration expert take a second look at what you have. Sometimes, there are over-zealous USCIS officers who like to delay people for frivolous reasons. They could have at least sent your employment authorization to start with.

But I believe that everything is working together for your good. Every disadvantage will turn to a bigger advantage for you. 

Just know that we share your feelings and concerns. All will be well in the end.

Oh my god, I’m so late to this, it’s been a bit busy lately but I love coming here to check on the news and to see how is everybody doing. I’m so happy to read about so many great news that came along to some of the filers!!! ::sigh:: still nothing from USCIS other than a generic message that a decision on the expedite will be made “shortly”....it’s already been about 3 weeks. But apparently they have 30 days to decide on expedite, even though they tell you they’ll take just 5 days. They gave the same response to the congressman too. So there’s really nothing we can do but wait. It’s so disheartenening.  No EAD, no interview, nothing. I wish we could understand what was going on. Just to know where it is in the process, are they doing extended background checks, is it waiting in a line to be looked at, what’s actually happening? 

 

We we were hoping to get the EAD before we moved (still in same city) but hopefully we don’t have any delays in getting the mail to the new address. 

 

BUT we are trying our hardest to stay positive. Excited about being able to enjoy the holidays in our new place. And looking forward to all of the good news that the New Year will bring!
