Hey guys...thanks for all the messages you guys have sent me. I appreciate it a lottttt. I don't think I will receive my EAD any sooner because I've received a RFIE and am working on it. I hope you guys can help me out with some answers to a few questions. I"ll tell you what happened...i"ll try to keep it short

 

My wife receives SSD benefits (so that's her only income) and she's also a representative payee for her nephew whom she has a custody and so his SS also comes to her. During my K1 visa interview where we have to provide I-134 Affidavit of Support she did send in her SSA-1099, her nephew's SSA-1099 and she also sent in my father-in-law's SSA-1099 ...BUT she did not manually total up all three incomes on I-134...she only added her SS and her nephew's SS which was about $29000 and she wrote the same on """3. My Total Annual Income is- $29,000"""and on I-134 they did not ask how many household members etc.... If she had added my father-in-law's SS as well then it would have been $40,000 +..Anyways...my K-1 was approved and here I am in the US...

 

Right now we have sent in all 3  SSA-1099s statements with AOS and now the total household income is $40,000+..Now my question is

1. When they accepted her SS and her nephew's SS combined annual income for I-134, will they accept the same now as well for I-864?

2. The nephew am talking about is 17 years of age and so he cant sign I-864A..what do I do? (they requested for his I-864A in RFIE)

 

One mistake what we have done is, for I-134 she directly said her total income is $29,000 and sent the SSA-1099's and got approved but now she has individually mentioned incomes as seperate as they asked for household income..so in her income she put $XXXX, nephew's income as $XXXXXX and father-in-law's income as $XXXXXX and we already sent in father-inlaw's I-864A but didnt send in the nephew's I-864A as we thought it comes under her income as she's a representative payee...

 

On the instructions page this is what I saw..

"Signature. Each contract must be properly signed and filed. For all signatures on this contract, USCIS will not accept a stamped or typewritten name in place of a signature. If you are under 14 years of age, your parent or legal guardian may sign the contract on your behalf. A legal guardian may also sign for a mentally incompetent person.

If you are under guardianship, your legal guardian may print your name and sign Form I-864 for you. “Legal guardian” includes any person who is appointed and authorized by law to protect your estate as a result of your incapacity. The legal guardian must present proof of the appointment as legal guardian of your estate and a copy of an order from the appointing court or agency specifically permitting the guardian to make your income and assets available for the support of the sponsored immigrant."

 @Aviinashh  I cant believe that they have your file all these months and waited until now to give you RFIE this is not right - but even this can be fixed - You said you don't believe that you will receive your EAD any sooner - maybe it's not the EAD you are going to get but your GC - so see if you can get whatever they are asking for to them ASAP.   I don't know too much about the combined income.  I hope that our colleagues here will shed some more light on this.    It would indicate that your wife could sign her nephew's filled out form I-864A only if she is the legal guardian for him - but she would have to show some proof where she is legally his guardian.  In that case then all three income should be combined together and put as the Total Household Income -  Filled out 3 different sets of I-864A attached all the relevant documents to them and send. But don't take my word only, unless whatever I wrote here is confirmed - please get more information on this.   I quote this information here from the USCIS site " see below:

You must provide the name, relationship and current income of any other household member whose income will be considered to support the principal immigrant and any family members listed in Part 3.

These household members must share the same principal residence as the financial sponsor, and must also complete Form I-864A, Contract Between Sponsor and Household Member.

You do not need to list any household member’s income in Part 6 if that household member does not intend to provide financial support to the principal immigrant.

 

You must provide the current annual household income for yourself and any household members whose income will be considered to support the principal immigrant and any family members listed in Part 3. In order for the household member’s income to be considered in support of the immigrants, the household member also needs to complete Form I-864A, Contract Between Sponsor and Household Member.

@currywarrior  You see it right:unsure:.  I tell you, the Dallas Office is moving like a snail - it takes between 8 -9 months nowadays to get an interview with them - we looking at between April - May 2018.

Is the RFIE for GC, or is it for EAD/AP though :o ? Can'T they just sent you a work visa either way...

What a bummer.....I wish I could help but it looks like this is very specific to your case @Aviinashh. I'm not sure how to help since this seems to be very particular, I will probably let to the ones who have experienced or gone through the same thing respond to your question.

 

But i would have to agree, couldnt they issue your EAD/AP even with the RFIE......anyways my friend, hope things get rolling again for you soon.

Hello new friends! What is my next step here?

 

We still haven't received my husband's work authorization. It's showing last updated on 9/14/17. He sent in an inquiry through the website 2 weeks ago, and still has heard nothing back. The automatic reply said he would hear something by 12/14.

 

Should I contact our Senator, or call a hotline?

I would contact the congress person. This seems too be what is working best.
