My husband who currently only has a work permit not a greencard has been summoned for jury duty. He doesn't speak much  English though, so I'm sure he won't be selected for a jury. I'm wondering if anyone else has dealt with this. Will he qualify for an excusal or does he still need to show up?

From everything I've read, non-citizens do not qualify for jury duty....

 

Only US citizens can be jurors. Both documented and undocumented immigrants often receive a summons for jury duty, as many are licensed drivers. The summons will usually ask if you are a US citizen.

Immigrants can prove they are not eligible for jury duty by showing the court their green card, passport or immigration papers.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

simply check the box saying he is not qualified because he is not a usc and mail back the card. 

 

serving on jury duty could be seen as a claim of us citizenship which will make him deportable.

 

also check to make sure he was not registered to vote and if he was get him unregistered and get proof in writing.

This was my first thought as well. I would strongly advise to check in to this. This has been known to happen and will cause major issues down the line.

Please pay attention to this, this is a separate process from responding to the jury duty summons and you need to do both.
