Hi guys! I have a friend who has a bf in the US without a status and they were the planning on getting married. Now the problem is that they dont know if she is going to have a problem by the time she go home and come back in the US. Will the immigration know if she is gets married here? Will they do the phil.embassy wedding or state wedding?

While others can answer with some assumptions made, better you make it clearer of the following info.

1. Your friend is a citizen of which country?

2. the BF is a citizen of which country?

3. Who is out of  (without) status?

4. How did the person came about of being out of status? 

5. where is the "home" she wants to go to? and Why?
6. Why not marry before going home?

Definitely need more info. To answer something... immigration will know about the wedding because if you're out of status and want to have some legal status, you need to send immigration whole bunch of paperwork and even more money. So they will know.

Out of status or not, I think they can get married just fine. Getting married is not the issue here. The main issue now is that your Filipina friend is out of status and deportable. Not a joke!

 

If the bf is a US citizen or LPR, then get married and adjust her status while in the US. However, she cannot leave the country in the meantime. In other words, she cannot tie up any loose ends she might have back in the Philippines immediately.

 

On the other hand, if they get married and she leaves the US, she would probably incur a bar because of her current overstay. She wouldn't be able to re-enter not so much because of the marriage, rather it's due to the overstay itself.

 

For a B2 visa holder who didn't overstay, the couple could have easily gotten married and the foreign spouse returns to his/her home country whilst his/her new American or LPR spouse petitions him/her for a spousal visa.

Do you have a Tourist Visa to visit the US? Would it not be easier for your BF to leave and marry you in PI?

They're both filipino citizens. The BF is out of status. He was on a student visa before. The girl wants to go in the US to get married with him and go back in the phil. After. So she was wondering if shes going to have a trouble by the time she going back in the US?

The girl has a tourist visa. Her BF is out of status and decided to stay in the US. All they want is to get married in the US and the girl go back in the phil. She just wanna know if she is going to have a trouble in IO by the time she wants to go back in the US. Is getting married to a Phil. Embassy is the safest way or state wedding should be just fine also?.

LOL. So your friend wants to marry a dude who is living in the US illegally and wants to stay here, while she wants to remain in the Philippines. That's the situation? Sounds very promising! It also doesn't sound like a legitimate/honest story. 

 

Anyway, assuming she just comes here, gets married, and returns home, no, US immigration (USCIS, CBP, ICE) will not know she got married nor care, assuming she does not offer that info when entering the US. If she tells CBP her marriage plans when she arrives, well, she probably will have an "interesting" experience trying to enter the country.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ok boyfriend out of status. Girlfriend wants to marry him and return home. Hmmm. If they are so in love why doesnt boyfriend leave us voluntarily and go home and marry girlfriend. I swear these two are confused at best but I'm sure they are not as they only want to know what would be best to get around their current situation hence why they ask the question. The situation just doesnt make sense at all.

 

Do update us on the success or failure of trying to commit fraud well another fraud seeing boyfriend is already out of status.

and i thought one of the person involved is at least a LPR or better yet a USC. 

In this case, why bother going to the USA to get married to someone who is currently in the USA illegally? Why must she travel to the USA to get married when both have homes in Philippines (and none belongs to the USA)?
