I601 proof of rehabilitation

Hello, we tried originally to immigrate from 2009 to 2012 but were ultimately denied because of my husband's previous cimt. Our case was being sent to court with deportation proceedings and so my husband decided to leave, also to seek medical treatment in his home country which would have cost him thousands in the states.

 

My original I601 extreme hardship waiver was denied but it has now been over 15 years since the crime. My question is, if he tried to immigrate again using consular processing, can we file an I601 citing rehabilitation instead of extreme hardship? I've been residing outside of the US since 2012 with my husband which will make citing extreme hardship almost impossible, the only thing I could go on is postpartum depression and lack of support outside of my home country which I don't think is sufficient enough. However, we can easily prove rehabilitation, no offense was committed after the original offense and it was expunged from court in 2011.

 

I'd really like to take my usc son home to stay in the states with my foreign national husband, is there any possibility in this? Thank you.

Of course you can again petition him, however the I 601 approval will come from the embassy at

interview, If the approved petition was kept live then you could request that be resurrected and

re-do a stronger waiver packet. it MUST have hardships (seem U have some) living in his country

financial medical & emotional.

Rehab letters will help proof must be shown from reputable places ....what is he rehab-ing

Please remember not all CIMT have waivers so speak to a professional at least

Hi, sorry it took so long to respond. He was mailed a fake check in a mail scam, the type that says "If you send us 20$ we'll send you back 200!" He was young and scared so he plead guilty to forgery so he could go home instead of face jail.

 

I can get with our old lawyer. How would i see if our petition is kept live?

Timeline

You can check to see if the I 130 is still live otherwise you need to start from scratch, they will tell you what waiver is required at the interview, I 601 I assume.
