My fiancé and I were trying to read up on going about the AOS. He will be arriving near the end of May, with a wedding date of August 11 which will be near the end of the K-1 90 day period. We were wondering how long the AOS takes to get after submitting the forms and also how long it will take to recieve work authorization after marriage.

Also, after his K-1 visa expires, will he have to leave the country even if we have sent off the forms for AOS?

AOS can take anywhere from a few weeks to a few years. for EAD/work auth it typically takes 80-120 days. you do not have to leave the country while waiting for AOS unless you want to start all over again with a spousal visa.

No, your fiance should not leave the country. You should file AOS as quickly as you can after you get married. The most important thing is getting married within that 90 day deadline. After that you will go out of status, but that doesn't matter to USCIS when you file AOS.

If you are anxious to speed up the AOS/EAD process, you can do all the paperwork after your fiance arrives in the U.S. and then mail them right after your wedding.

You can get everything else together, except for the certified copy of your marriage certificate. Once you receive the certified copy, you can send the package away right away.

We asked the judge who married us to give us the signed marriage certificate right after the ceremony. We took the signed marriage certificate to the court house on the first business day (Monday) after our wedding (Saturday) and got certified copies while we waited. We then put the certified marriage certificate in our package and threw it in the mail that day. Usually, the person who performs the marriage ceremony mails the signed marriage certificate into the court house, but that can cause several weeks delay in getting your certified copy. So, be sure to ask whoever performs your marriage ceremony if you can get the signed marriage certificate right after the ceremony for you to take to the court house yourself.
