Guys Could you please advice on this concern. I have a daughter with my wife . 5 years ago,  my wife and I got divorced  . She married a man and her husband filled a petition for my daughter. I was in usa and i also filled a petition for my daughter. The problem my Daughter got two petitions at NVC with two different DoB. There was a mistake in her first birth certificate when the other guy was applying for her. My petition for her is current  now with the good DOB, she has her passport with the right DoB and we have interview next month .  Do you think NVC and The Consular Officer will find out that she has two different petitions ? And how this could affect her to get a visa ?  Thanks for your help..

How can her step dad not know her real birthday, did the mom not correct him?

Yes, this will cause issues.  The best thing would be for step dad to correct his petition with the amended birth cert and an explanation on how and why he got it wrong first time.

Thanks for your prompt answer. Her mom did not correct the mistake in her birth certificate.  For the time being  .. her step father 's petition we dont make the follow up for it ..  i just want to know if the CO or NVC will find out there is another petition for my Daughter even if we don t pay visa for it ..

Yes, they will likely cross reference.  There is also a question at one stage of the process about other petitions filed, and you need to be truthful.

You are getting dangerously close to asking if you can get away with visa fraud, and Visajourney will not help you with that.
