I-130 Petition for immediate family memeber

Hello,

I am the US Citizen who petitioned my fiance and her son last year. My fiance arrived here to the US on Feb 25th and we are married now and she is about to receive her Temp green card. I also petitioned her 13 years old son to come with her on the K2 Visa, but we/he decided to finish his high school first, even though we paid the fees for his k2 visa but we did not schedule the interview and we emailed the Embassy in the Philippines letting them know we will not proceed with the k2 visa. 

immediate family immigrant visa and file I-130 form. Do I the US Citizen petition him, if so, do I check the box as my stepson? Or, can his mother petition him as a green card holder?

Yes, the USC should petition for the stepchild. ETA: ~1 year. If the immigrant petitions him (after getting the green card!), it's about a 2 year wait.

The I-130 is the petition the USC files. The CR-2 (CR-1 is for a spouse) is the visa your stepchild will apply for once the I-130 is approved.

Got it, thanks! So CR2 is the one to apply for the stepchild.
