Hi Folks...new member here with some questions. Let me explain a little bit of what is going on with my spouse and I.

 

We are a gay couple and filed our paperwork in September, 2013. We still do not have a decision yet. However, we did get a Notice of Intent to Deny(NOID), in March of 2015. We hired an immigration attorney and Timely filed our RFE paperwork along with brief and psychological report for the AWA issue and all other required evidence that USCIS wanted. In July of 2017,(last month), we received a Notice of Interview for our I-485. There is still no decision on the I-130(AWA Issue). We contacted our attorney and he contacted the USCIS office and they told him that there is no log of any activity made on our case since 2013(when we first filed it), because there is a disconnect between what is contained in the physical file, where a log of case work is kept, and the online database. The USCIS officer could only find the online database information. Sounds like no one has worked on our case at all almost. The USCIS officer recommended to our attorney that we do an Infopass and take all the files with us and proof of delivery and ask what the status of the case is.

 

Our question to the forum is: Should we just go to the Interview as others have done and who have received their Green Cards without having the AWA(I-130), issued decided first and who then had their I-130 approved within days after receiving their Green Card granted...Or should we do the Infopass and take all the records with us to see what happens?

 

Is there anybody out there who has had a similar experience?

Just a few more days and then our Interview comes up on Monday, August 28, 2017. I will be sure to post here on what happens so everybody will know a little more about AWA Cases. Take care

Hello everyone...I'm very sorry that I have not been back to post here and keep you all updated on my AWA action. There has not been anything to post until January 2020. On January 30, 2020, we had another interview at the Atlanta USCIS Field Office. It went very well. The lady interviewer was very nice and we had a good interview. A month after the interview the Interviewer called us and told us they needed some paperwork on me and so we took care of that and hand carried that to her on March 4, 2020. Well, guess what? On March 27, 2020, we got an update from them which said that our New Card was being made!!!

After 6 and a half years we finally got our Green Card folks. We did everything that they asked to do and stuck it out and WE WON!!! On April 1, 2020, they gave us another update and said it was in the mail and gave us a tracking number. I checked that number today, April 2, 2020, and it said the card would be delivered tomorrow, April 3, 2020.

So you see...you can win an AWA action with Immigration. Just stick with it, have an attorney, be truthful and do everything they tell you to do. Make sure your I693, physical exam is up to date including vaccinations. I will check back every now and then to see if there are any replies.
