sponsoring family

Hi,

My wife and I are us citizens and want to sponsor her family to the United States.

I've read numerous resources and posts, but was looking for a more clear cut answer to due conflicting data points.

We want to sponsor her parents as well as her siblings (1 brother who is 13 years old, 1 sister who is 16 years old)

I just want to confirm that we would have to sponsor her parents first => they would then sponsor the siblings upon arrival in the us.

Would this be the quickest way possible??

We've heard that if we filed for the parents that the siblings since they are minors would accompany the parents automatically.

Any advice or help would be greatly appreciated.

1. That would be the quickest way.

2, Not so, immediate relatives do not have derivatives.

I am pretty sure that because the kids are < 21 they can come along with the parents in the same petition.

PS: because your wife is US citizen you should put "naturalization completed" rather than K1 because otherwise people will give you the wrong advice.

Actually, nope. As USCs, the parents fall into the immediate relative visa category, which does not have a wait for a visa, but also doesn't allow derivatives. The children need to be sponsored separately...which means a LONG wait for siblings (unless the parents come to the US separately then petition for the kids...then it's a shorter wait but involves separation).

Oh, that is sad!

It is a good idea to have 1 parent come. If one parent comes and becomes a permanent resident, would it be a 2 year wait for the other spouse and the 2 kids?

Better than letting the kids turn 21 and go to a +7 year wait.

I guess the parent could also get a 1 year reentry permit and travel to their country so that the separation doesn't get that bad.

Yeah...definitely not an "easy" option here. Sorry for the brevity...I'm on my phone for once. haha

You could have one parent be sponsored, then that parent can petition for their spouse (with both kids as derivatives) under F2A with the 2 year wait. But the parent needs to live in the US still...meaning separation of the spouses and separation of one parent with the kids. A re-entry permit itself isn't an issue, but the purpose of the immigrant visa is to live in the US so getting the visa with the intent to live abroad still wouldn't be permissible (not to mention I'm sure the CO would see what's likely going on with only one parent going at a time). Or maybe I'm being overly cynical tonight.
