Dear Friends, I have some questions about to apply for AOS. When I was reading the instructions on form I-485 and it said about 3 year ban If alien were unlawfully present in USA before the AOS applicatoin. I was unlawfully present in USA for 6 months in 2000. At the time when I applied for K1 visa I told about this on forms and I got my visa, I am in USA now and I married to my fiancee last month, I worry If that overstay will cause a proplem when we apply for AOS. Another thing is about my criminal record, also I told about my criminal record at the time when I apply for visa at embasy and I didnt need waiver for both overstay and for criminal record. Is there anybody out there with same or similiar situtations who applied for AOS to share exprinces on this subject please?

I think, someone with overstay and criminial record and got visa from embassy/ consulate then dont need to worry about AOS, right?

Your overstay will not be an issue. USCIS cannot hold any overstay against you if you are married to a US Citizen.

The criminal record depends on what the offense was really, so I can't really advise you on that.

Thank you for your reply, my criminal record is about Threat it was six years ago and Embassy issued visa without any waiver. I hope It wont be proplem at the time of AOS.
