Dear all,

 

I am filling out the I-485 for my AOS and I have hit some parts of it that I don't know how to answer.

 

The first of which is in Part 2.2 where it asks this:

I am a K1 Visa Holder so I am applying for a family-based however I have not seen anything about this before. What should I do?

 

 

Secondly, Part 2.3-9 also has me confused as I do not know if I fill this section in at all. As I'm just applying for AOS now I don't believe I have an Underlying Petition as my K1 is all in the past. Can anyone shed more light on what I should do?

The INA thing is 'No'.

 

Underlying petition would be your I-129F WAC number. Priority date would be the NOA1 date :)

 

Items 5-9 do not apply to you. That's for if you have a K-2 or bringing a wife or husband from your home country.

So I'm looking at my approved I-129F. I see the WAC<numbers> and to the right of those is a date from last year underneath the barcode, I assume that is the priority date?

Refer to 'Notice Date's in the top right corner of your NOA1 paper copy.

I'm not sure I can find the NOA1 copy. I've googled it online and it doesn't look like anything I ever got. I have a letter from the London Embassy saying they have received an approved petition and I have a copy of the approved I129f.

Oh! Is your NOA1 hardcopy with your wife? :)

It makes sense it was sent to her instead but she can't seem to find it. It was over a year ago :/ Is it definitely not something that would be on my copy of the approved i129f? I also have a priority date on the letter from the embassy which talks about receiving an approved petition.

Your timeline here says August 4th 2016 :) What's the date on the letter you're looking at?

The i129f with the approved stamp is 07/25/2016 and the letter is 09/01/2016.

The start of the validity date would be your NOA2 date. Your NOA1 was probably 7/25/2016. Your timeline was probably not updated correctly :) The date on your timeline is the date you guys received the letter but not the NOA1 date.

If, the WAC is right and the date is wrong, create any big problems for the AOS application?

I doubt so. But you guys did mail out the I-129F 7/22/2016. Therefore, I don't think my guess is incorrect when I said your NOA1 was dated 7/25/2016 :)

We just used the USCIS online checker and put in our WAC number from the i129f and got this out:

 

"On September 1, 2016, we approved your Form I-129F, Petition for Fiance(E), Receipt Number WAC<number>. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

We also found the I-797C Notice of Action with a Notice Date of July 27th 2016 and Received date of July 25th 2016.

That's the NOA2 date. NOA1 date would be when the "case was received" when you look at the tracking.
