Hey all :)

 

I just have some quick questions, and I'm hoping someone can answer :)

 

I have a boyfriend in the US. I'm from UK. We met online.

I first visited from June 30 til July 20 last year, in 2016. I then visited in April this year, over the Easter break, for just 5 days.

I have purchased a ticket to visit him again on August 25th this year, for 11 days, returning to the UK on September 4th.

 

My question is, as I'm on an ESTA, am I leaving a sufficient time apart from April to August, for another short visit? I've never had an issue before at the border, and I'll be bringing lots of documentation to prove ties to my home country, proving I intend to return after the 11 days.... so will I have a problem?

 

Also, the plan is to visit my boyfriends parents house throughout the 11 days. Literally only because it's cheaper than a hotel. My previous visits have been at nearby hotels. Will this be an issue? I'm happy to stay at a hotel if that's what it takes to see my boyfriend again, I miss him so much :)

 

I am also wondering if the documentation I can currently offer is enough, to prove my innocence and my intent to return home. I'll be bringing payslips, a bank statement, proof of address, proof of ongoing car finance, letter of employment from both employers (my second job is a weekend role), a signed letter with contact details from my boyfriends parents, stating that I will be visiting them for the 11 days, a thank you card from my mom with cash for rent, intended for my boyfriends parents. I also have a gig I am going to in March, back here in UK, shall I bring my ticket information and an email conversation with my Dad to prove this event? I am also going to Australia for 6 months backpacking in April next year, shall I provide evidence of this? Will this help at all, or just be dismissed? 

 

With it being my third (albeit short) visit, CBP might be unhappy with me visiting my boyfriend infrequently, might assume illegal intent and ban me for 10 years. I really could do without that :( 

I'm probably worrying over nothing, but just making sure!

You should be fine as most of you visits have been short and you have spent more time out of the country than inside.  People using ESTA for 90+ days, leaving for a week or so, then coming back are the ones that generally have issues.  Regardless, every time you do visit you are subject to questions regarding your intention not to stay as you already know.  The documents you have seem good, my only suggestion would be to get a letter from your employer stating that you have not left your job and are expected back on whatever date after your holiday trip.

That's a relief. Yeah, I hear of people attempting to "reset the clock" by visiting Canada or Mexico for like, a day, and wondering why they're unsuccessful :')

 

Exactly. The last 2 times, I didn't even take it into consideration, the possibility of further questions, requests for documentation etc. I guess I got really lucky both times (CBP officers in Philadelphia were very nice and friendly, despite what i've read in forums). From now on, I will come packed with evidence and documentation, just in case.

 

Yup, I have that letter. I have 2 letters, one for each job. By the way, the second job is a "self employment" role, where the Company sends me work in the form of customers, and I report to their houses and fix PC issues (PC Field Engineer). This is a weekend role that I mostly do for fun, but is a real wage. Are self employed jobs like this one dismissed as "meh" or are they considered as sufficient evidence? It's not a huge issue now as I have a primary day job too. Just wondering. If it helps, i've been at this self employment role for over a year now, proving it's not just a one off job. 

 

Also, my CEO was wondering, do CBP contact employers directly, for further verification? My boss has only included his e-mail address, which is obviously (especially with the time difference) not the quickest form of contact (I doubt they'd want to keep me imprisoned for possibly up to a day waiting for a response, possibly all weekend as I'll be entering the airport on a Friday).

You are staying for 11 days. You have been away for 4 months +. You have a valid ESTA. They wont be contacting your employer. Take a step back and relax, you will be fine.

They are unsuccessful because traveling to those countries does not "reset the clock". It is a myth.
