Yes that is true but I have to file in 3 months so I don't really know what option I have apart from using the bank account I just opened but to me that looks a little fake.....we do have the joint credit card that my husband has maxed out, the joint bank account that is not used on a daily basis and a value city furniture credit account, would that not be enough for them?

Does your amended return's status show as completed? Once it shows as completed, go here: https://www.irs.gov/individuals/get-transcript

Request for tax account transcript either online or by mail.

 

Tax returns are what you or a tax preparer makes to be sent to the IRS. Tax transcripts are proof from the IRS that you have complied with filing your taxes for whatever year and you have problems with the IRS.

Thanks, I did what you said and unfortunately they only sent me my husband's tax return before it was amended. I may have to try it online vs the mail.

Ok thanks and when you say transcripts you mean my husbands amended tax return transcript and mine too? We filed married but filing seperately

Sure, USCIS put them in their example list and they think they make a great piece of evidence of bona-fide-ness (I think I might trademark that word), but there is no legal requirement to submit them. 

 

If you do get an RFE or an interview, then with current processing times they should be all amended by then and you can submit/produce them should you wish.

 

 

 

EDIT- I see @Cookiecat posted exactly the same above. That will teach me to skim read on a phone...

How about bonafication?  That's a fun word too!  :jest:

I am almost in tears. What if the amendments haven't been done by October when I need to file my I-751? What will happen? Will I be denied and sent back to my country? I don't know what to do. You should do what you need to do with your state tax returns, of course (amendment, etc.). However, when you send your I-751 you send what you have ready. I have never submitted or used state tax transcripts as evidence during the I-751 process. Only federal.

You submit your tax return transcript and his tax account transcript that reflects the amended taxes. You'll have to order both online if you don't have yours already.

Quick question so I received my husbands tax transcript hurray! When I send this in should I also send in a letter explaining what happened, how the accountant didn't put my husband as married so we then needed to do an amended tax return to reflect his correct status? Or do they not need to know this?

it is irrelevant as to why the taxes were filed as single so blaming the accountant is pointless.

Tax returns are not a mandatory requirement, you don't have it, and you can't provide it. 

 

You cant provide what doesn't exist!
