How to expedite AP / EAD after USCIS error?

Timeline

Hi, our AP / EAD card expires on Sept 4, 2017. We currently have a i-485 pending, so it was my understanding that payment is not required to renew the AP / EAD. Then here is what happened:

 

  1. May 12, 2017: Initial renewal package received by USCIS
  2. June 3, 2017: Request by USCIS for "missing payment"
  3.  June 9, 2017: 2nd renewal package received by USCIS (including check for $410)
  4. June 26, 2017: NoA received by me, returning the check and saying payment not required (!!!)

 

W-T-EFF!!! Is there any way to expedite the AP renewal at this point? We have tickets to go to Spain on Aug 30 and being that we were delayed 1.5 months by the USCIS payment error/incompetence, I now fear the renewal will not land in time. Is there anything at all we can do??? Thank you!

USCIS will run the same security checks and use your biometric data as in the past, however, it is not necessary for you to appear at a USCIS Application Support Center (ASC) for biometrics appointment."

Sept 13, 2019:  Notice that I-751 was transferred to another office "That office now has jurisdiction over your case" 

Apr 7, 2020:  Notice that I-751 was transferred to another office "That office now has jurisdiction over your case" 

Mar 5, 2021:  Interview scheduled for April 16, 2021.

Apr 16, 2021:  Interview in Portland, OR. Refused entry to USCIS office due to have traveled abroad in the past 10 days. No interview. However, a few hours after refusal, received notice of approval and card produced!  

Apr 20, 2021:  Card mailed! "On April 20, 2021, we mailed your new card for your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE"

You should provide a copy of your I-485's NOA1 with your AP/EAD submission. That acts as proof that no payment is required.

 

For the EAD, there's now an automatic renewal of the existing EAD for 180 days once you file for the renewal:

https://www.uscis.gov/working-united-states/automatic-employment-authorization-document-ead-extension

 

Unfortunately, I see no such automatic extension for AP. You can make an Infopass appointment to try to explain the situation, but I'm not sure what you can do beyond that besides calling up USCIS and requesting an expedite. However, I don't personally foresee it being approved. Only way to know is to try.

Unless there is an urgent emergency, you won't meet the requirements to expedite.

However, I looked at your timeline and the processing times for you local office - you should be able to submit a request for someone to look into your case. It looks outside of current processing times. That might be the ticket to get it decided ASAP. Call USCIS and also, schedule an InfoPass appointment in the interim. Explain your upcoming travel and also that your case is outside of normal processing time. You *might* be able to have them review it in time. I think your full AOS will come before the renewal.
