will my application likely be denied?

Hi all..appreciate any insight.

 

I am a US PR, canadian citizen. i studied undergrad in canada for 4 years, visiting back and forth on summers, holidays, etc. ive just met my physical presence requirement. i have two questions:

 

1)do i need to list my dorm address in canada where i stayed for 4 years? or can i use my parents address in michigan,since i was financially dependent on them.the michigan address is also my official address

 

2) after graduating i took up a paid internship in canada for 5 months. would this be grounds for denial? i am currently employed in michigan, and its been 2 years that i've been working in the states.

Yes.  You were physically living there.

 Hopefully you filed US taxes claiming foreign income----which would be a huge mark in your favor.  However, taking up employment in another country may have been seen as abandoning your resident status in the US by working/overstaying in Canada.

Forgive me, but I'm curious about this.  If you were studying in Canada for 4 years....and only "visiting" the US on summers and holidays---how many days total have you been outside of the United States in the past 5 years?

 

Permanent Residency means most of your time is to be in the US...studying in Canada for 4 years sounds like most of your time was in Canada?  Either that or you're cutting it really close with the number of days outside the country.

Hi going through..thanks for the replies. So, I've been in the states for the past 2 years continuously. Prior to that I was in school in Canada for the 4 years, during which I visited the states on breaks. Im definitely just meeting the physcial presence requirement, but I'm anxious to apply because I have a spouse in Canada whom I am living apart from for the time being.

 

i did have authorization to work in Canada being a canadian citizen..I am just hoping that they give some leeway since it was an internship. I did report the foreign income.  Very stressed About this though...I didn't really pay attention to this stipulation when I was a student 

 

For the foreign dorm address, would I just list a cumulative date for example, 2012 - 2015... or should I break it down by each semester I was there

Break it down by each semester/amount of time you were actually living and residing in the dorm.  To do a cumulative date would be shooting yourself in the foot because you would be claiming you were living outside of the US even longer than you actually were, since a semester year is not the same amount of days as a calendar year.   Of course, if you resided in Canada during your semester AND any days after school was out for the semester, you would include that time as well.  It is very important that you remain truthful.

 

Since you just meet the physical requirement, you want to make sure you are listing the dates accurately.

Since the internship was a paid internship, it is viewed as employment.  It is very good that you reported the income on your US taxes, which will go towards showing your good moral character.  The paid internship was only for 5 months as you said, so it shouldn't be a huge deal...USCIS will be more concerned with whether you filed taxes for it or not.
