Hi, 

 

I am new here and not sure how to search the forums, the K-1 guide on this site has been great but the K-1 form has been updated  and so the example does not apply. Now there is a new section that asks biographic info for easier biometric set up.

 

I just dont know if that is my info they want (petitioner)  or my fiance, the beneficiary.. I am totally stumped, hopefully it is an easy answer.

Did you mean the I-129F form? If yes, the biographic info refers to the US petitioner's info. That is highlighted clearly in the I-129F instructions.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

HI, thank you for the reply, yes, I was referring to I- 129F  but it did not seem so clear to me. in the instructions that you mentioned, here it is:

 

Part 4. Biographic Information Provide the biographic information requested in Part 4., Item Numbers 1. - 6. Providing this information as part of your petition may reduce the time you spend at your USCIS ASC appointment as described in the Biometric Services Appointment section of these Instructions. Item Numbers 1. - 2. Ethnicity and Race.

 

 

I trust that you are right, but I thought the biometrics was for the beneficiary, not the petitioner,   WHo needs biometrics? it seems weird that the US citizen petitioner has a USCIS ASC appointment or would need biometrics. But I am new to this, so again, I trust those who are more familiar with this process.

At this stage the bio info is for the petitioner. They are the ones needing to prove identity criminal background etc at the petition stage to be approved as a petitioner. The beneficiary provides further info with the K1 application process at the embassy.

I have already received NOA1 last week but i realised that I answered the biographic information about myself (the beneficiary) instead my fiance (the petitioner) :( so I know we will be getting an RFE at some point for this, but should I send USCIS my fiance's biographic now even before they send us an RFE or at least a letter to them explaining my mistake?

Unfortunately you can't add info to a petition until you are sent an rfe. Your case will sit and wait to be assigned to an IO at uscis and at that point they should notice it. It is also the petitioner that needs to handle the communication with uscis at this point since it is their petition. I tried calling asking about ours last summer and was told to have the petitioner call back. 

He could possibly make an infopass appointment or try to speak to a tier 2 IO at the helpline to see if anything can be done but likely you'll have to wait it out. Worth a shot though :) good luck.

thanks for the info :) fortunately we aren't in too much of a rush as we arent getting married until July 2018 but I would still just rather get the RFE sooner rather than later, especially coz NOA2's are taking so long right now!! But I will ask my fiance to call the helpline and maybe someone will help us :)
