Hello all,

I applied for AOS when we were leaving in Florida. Our company transfered us to California and we could not make it to the interview so we rescheduled it. Since then, February 2006 we have not heard anything about our case. It shows that it is in the National Benefit Center. I requested my case to be transfered to California last August and got a confirmation for that request but no changes, no updates.

Should we try to submit all our paperwork (I130 - I485) again here in California? Can we do this? My Employment Authorization is valid until Nov 2007.

Advices?

Yes, I did. 2 times. The first time was never recorded ( I guess I talked to a "ghost" when I called USCIS b/c they did not have any records of any changes) and the second time they sent me a confirmation letter.

I just scheduled an InfoPass appt for Wednesday. It will be the 4th time that I going over there but they never know anything!! Ayyyyy!!! I think we should get a lawyer.

A lawyer would not be able to help, being that you have no idea where you are in the process. But if you feel more confident doing do, have at it.

that is very scary! this makes me convinced to file EAD and AOS separately cuz what if my EAD gets stuck with AOS processing and we wait until EVERYTHING is approved! this is really confusing.

Has anybodys EAD got stuck with the AOS processing??? or did you receive EAD while AOS being processed?????

it is a very rare occurance where the EAD is held up due to an issue with AOS. VERY rare. it would make much more sense to me that this OP's issue was the move after filing (btw - the op does not mention filing EAD at all).
