Let it roll guys, if you already sent a request the worst case they'll just send you a letter saying you are in normal processing times.

I don't think they will disregard your inquiry ticket. They will call you back and saying that you are within the normal processing time.

They might realize that after they received maybe a thousand of inquiry ticket :lol:

Quick question guys, we are August filers. We did not include my girlfriends' child on the application, how hard is it to bring the child later and what procedures do we follow?

All children should have been mentioned on the I-129F.

You can send a letter to USCIS to request that they add the child. They may require a copy of the birth certificate to do so. Otherwise, the embassy should be able to make the amendment upon request. They may or may not ask why the child was not mentioned initially...it's not too uncommon for the petitioner to only find out about a beneficiary's child after filing.

Be sure they are listed on the DS-160.

 

How/When would the child be coming to the US? With the fiancee? Within a year after her? More than  a year after her? How old is the child?

The children were listed on the application but on the application, it said that they are not included in the petition. My girlfriend changed her mind and I did send a letter like they advised me to but they sent it back to me with a "general inquiry form letter. If I cannot get the children added what is the process? Is it another K-1 or some other immigration procedure? The children would be coming a year after her if we can get it done.

I'm sorry, but I don't understand what you mean here. The petition (I-129F) has not been approved yet according to your timeline, and does not ask which children will apply for a visa. So I'm lost as to how they were listed on it yet not included...? If you cannot get USCIS to add the child to the petition, then ask the embassy to do so (once the embassy has the petition).

 

A child can utilize follow-to-join for up to 1 year after the K-1 visa is issued. If the child is ready to enter before that 1 year period, they will need a DS-160 to apply for a K-2, complete a medical, and then interview. No new petition is needed.

 

If it will be over a year until they join her in the US AND the child was under 16 before the actual marriage, then the USC petitioner can file an I-130 for the stepchild. ETA: ~1 year from I-130 filing to CR-2/IR-2 visa being issued.

 

If it will be over a year until they join her in the US but the child was 16 or older at the time of marriage, then the child's mother would have to file the I-130 instead. She must have the actual green card before she can file, and it will take around 2 years after filing. This assumes the child will be under 21 years old at the time....this timeline goes out to around 10 years if the child turns 21 (and isn't protected by CSPA).

 

IN all cases above, getting the I-129F amended should be done. A child that they just learn of afterwards is going to raise a bunch of questions. It's not impossible to have it fixed later, but the sooner it's fixed, the better.

I saw in the earlier posts about people calling USCIS and putting in a request. Is there an actual benefit of doing that? I don't want to cause people who actually needed cases expedited more delays. Should i still do this or just be patient? Thank you!
