Hello, I am an August 25th filer, too. When did you get notified on your RFE? Hang in there, Good luck to us all!

Oh sorry, I meant that we know we are getting one because we forgot to include her birth certificate, not because they’ve told us. I mean, I hope we just get an approval but we are being realistic. Lol.

If I had to guess from what I've seen from others - I have a DUI charge on my record from about 8 years ago and I assume I'll need to provide records of that. Does that sound correct? Will having a criminal record be problematic? It was a DUI when I was 18, and I completed the community service.

Is there a rough average of time it takes once they receive the missing documents to when they approve?

For average times to approve- it's been around 1-3 weeks lately but USCIS says up to 60 days. I say tell yourself about 1 month and U should be good!

And for the DUI- if that is what they're asking for, the RFE letter will detail for you what you can provide. I think I heard someone in one of the other threads go the court and get some certificate signed.
I don't know about being problematic- I think it's more about disclosure and having the proper documents and you already did community service :D

Hang in there. So close to your approval!

Oh, okay. I hope they'll update 8/25 soon so we'll know what to do in case we receive an RFE;)

My fiancé has two. He called to the courthouse to get a certified copy before we filed, he had them within a couple of days. We havent gotten our NOA-2 yet (as we're only December filers) but I understand it shouldn't be a problem. It shows up on your record though, so they will need to see those papers (it's clearly stated in the petition form that you need to provide the court documents).

I see. We have a lawyer taking care of ours. I just don't recall ever even being asked about a criminal record. And if I was I certainly would've answered truthfully and (obviously) no documents were ever requested from me prior to filing. Very very upset over this.

Ouch... :( Yeah I'd definately take that up with your lawyer. Its very clear in the forms. I'm sorry. My view on lawyers in this whole K-1 process is not good at all. I see more screw ups than success.

Yea...
Our VJ record with lawyers have not been good. I think the k-1 process is simple enough and unless you have a complicated case, lawyers are not really gonna help.

But it's okay! It's a simple fix. IF it is the DUI, get the court documents and all is well
Wishing you a quick turnaround!

supposedly if it is not a felony DUIs are NOT supposed to disqualify you from this process... So 1 DUI should not be a problem. Did you disclose in your application? In case this is what your RFE is for and they want more documentation, you could go to the court where your case was handled and request a "court certified disposition".. It was very simple for me to obtain from the CA court system but others have said it took them more time in other states. I would check that out asap so you can send your RFE back speedy quick if that is what its about! Good luck :)

I see you are from Kentucky. My fiancé lives just on the other side of the Ohio river and had to get the court records in Kentucky. It was pretty easy.

@Naes is one of the most helpful and knowledgable people on this website as of late. They run the scans, often without thanks, and people ping them all day long to answer questions that can be easily researched and answered if one simply looks.

You told them that they were lying, that WAC scans could be done even if the case # wasn't updated on the USCIS website. You are the one that is mistaken.

As previously explained, people are getting their NOA2's one of three ways:

1. Via USCIS website/app update

2. Via USPS post, with no USCIS website/app update

3. Via tier 2 call w/ USCIS (and most of the time they cannot tell you, this is luck of the draw)

It's an open and closed book. If you come here asking questions, please be prepared to hear things that you may not want to hear. NO ONE is going to lie to you, at least intentionally.

Where did I said she lied about that ? Maybe you misconstrued I made a comment stating when the app or mail services weren't updated yet ( stating approvals etc) the daily scan which consisted of the case numbers can assist those who may see similar case numbers or their case numbers for some ease of reference because in most cases contacting USCIS directly or because in some cases with those like myself whom live in countries with poor receptions it is easier to identify approvals consisting of the wac numbers provided on the scans.  I stated I understood due to privacy these numbers where not placed on this forum which I have no problem with .

I merely stated from past experience when friends saw no activity on apps emails etc or still showed when their application was received and no further updates online until later that day or the day after the scan with case numbers assisted them.

As I said I never discredited nor did I said they lied to me or is withholding info etc .

I understand if the case has not been handled or processed yet to be placed on the scan it will not show up else where.

Have you already done the police report and have you got your packet from embassy yet?
