I think so! Now I have something new to obsessively stress about, AOS haha! For some reason I'm not worried about the Stockholm interview at all, but more paranoid about an endless wait for EAD/AP which can sometimes go over 130 days aaah. I will update you all along the way :)

I'm confused if this is the petitioner or beneficairy's child again... I'm going to assume it's the petitioner's child given the reference to their W-2. If instead you are referring to the beneficiary's child and they are not seeking a visa, they are not counted in the I-134 at all.

 

item #4 says "Enter the number of unmarried children you have who are under 21 years of age, even if you do not have legal custody of these children.". There's an exception for minor children living abroad not declared as a dependent on taxes who have reached the age of majority there, but that's a pretty rare case.

As such, I would say "partially dependent" would probably be most appropriate for a minor biological child where you are not currently providing the direct care for them. The CO will look at the totality of the circumstances to make a decision anyway, so I wouldn't worry too much on how to list them.

 

Some embassies are more strict than others for an I-134, and others don't even regularly request one. But you should still have it anyway (and most do request it). A copy of the I-129F packet isn't required at all, but is good in case any papers got lost along the way.

 

It depends on the totality of the circumstances as determined by the CO, but generally that should be perfectly fine.

Yep im referring to the petitioner's child. Since full custody was given to his ex wife. But still he has his child support. I will take your advice then, it would be better if he place it as partially dependent on him. Right? Thank you guys. ☺️

Hi all! Congrats to new approvals! 

 

Okay so I decided to go through my papers again to make sure I won't receive and RFE and like the genius I am.... where it asks for where your "beneficiary intends to live in US".... I put the wrong state!! The zip code is for the correct town, and the address is correct everywhere else, its just that one section! HELP! What do I do?

You don't do anything.

 

it may get an rfe than you correct it and send it back.

 

it may also get a normal human being whose smart enough to see and correct it.

 

theres nothing to do at the moment, and an rfe is nothing to be scared of. It is easily resolvable.

I really really realllllly hope and pray so! Hopefully they notice its the same address as each other things, stupid scroll bar! 

How long to RFE usually take? Will this delay the process? Noa1 was on 8/29/2017, which makes me hope they get to it soon! Hopefully this doesn't affect it to much! TY!

It won't affect it too much.

 

if it gets an rfe, you'll wait for it to reach you about a week, then after you answer and they receive it usually 2 weeks to 6 weeks. But this is a simple problem so it may take really little time to approval.

This morning I woke up with message from my fiancé. He got letter from uscis of REF, nothing was updated online, still shows received. Date of REF 14 February, received 22 February. Our noa1 August 7. Hope everything will go faster from now.
