Thats why they don't like me here (I go home when the bell rings.... and I used vacation days + unpaid a total of 40 days -which apparently the limit that you actually cannot be fired- to visit my fiancé! ) 😁

 

But I'm scared about job security in US, cause I would be fired last year if this was happening there...

As an August 18th filer, our approval should hypothetically not be so far away, but seeing the depressing strain it's putting on relationships on here when it doesn't come and how some people end up in a black hole for hundreds of extra days has me thinking, why the heck did I even go through with this process? I guess I was uninformed going into this and I wish I found this forum sooner.

Originally, it was so my fiancee could move to the US as I have a good job, but I can live in his country legally without any visa and he's from a VWP country. I so wish I could go back in time and file for a CR1 or just simply move there. If I reach 200 days with no update (which is exactly 2 weeks from today), I may just withdrawal to take my life back into my own hands. I'm really starting to understand why I read people on here withdrawing to go down another route on June/July threads. Possibly waiting for the NOA2 for who knows how many more days, then EAD/AP possibly for over 130 days... endless AOS/ROC for years... I don't wish this process on anyone. I understand why when new users come onto this site and the seasoned members tell them the option of the fiancee moving out of the US to their significant other's country or to do CR1.

 

This K1 hell is going to start a new wave of illegal immigrants who are fed up with waiting hundreds of days with no answers waiting for their lives to begin. We are paying for a service that leaves us in the dark. I get more answers from strangers on a forum. This process is broken and I really hope there are efforts to improve it as soon as possible.

Yes and ask for a tier2

 

or you can make an infopass to ask about the situation

 

but also the advice given before sounded legit to me..

Yes signatures are unfortunately not available to phone browsers.

I don't know how to solve your problem exactly but can tell you what I will do with same issue from an arrest at 18yrs old for underage party in Reno, NV.

 

1) I requested record from 1998 from the police department by email through the county address (look online for records request of the arresting agency). They mailed it back to me with a stamp and response that there is NO record or one could not be located.

2) I then requested the same from the local municipal court, paid $3.11 by phone, and they emailed me the same type of document called a "purging" response (as in they delete everything after 7yrs older than 2003 records in the digital age). It cannot be certified because they say "there's nothing to certify" and that's the end of that. 

3) I will attached all documents (request, receipt and court response) along with payment receipt for the $3.11 and my written statement of the arrest, location, agencies, no contest plea and $200 fine.

 

I will have the package (or statement) notarized tmrw and sent back immediately.

 

I will then call the USCIS line and request a TIER 2 agent exactly 5-business days after sending to confirm receipt and explain that I have a "unique case" where I was only able to provide a portion of the request (but hope that the balance will suffice) due to US local and/or state law that prevented them from retaining those records. They can then ask any questions, advise further or refer me for a call back if the adjudicator needs additional information. 

 

I hope this helps and good luck - it's a good reminder for all the kids out there to NOT BREAK THE LAW AT ANY AGE or you must pay in the weirdest ways throughout your lifetime! ;)

 

Thank you for sharing. I actually do live in Nevada. And I spent the WHOLE morning trying to obtain a “certified letter with a court stamp” that I couldn’t get because I have no juvenile record. I went to the juvenile records office and then the juvenile family services and I couldn’t get what I needed... and they mentioned me trying one more department but I was so overwhelmed and upset I just decided to come back tomorrow and instead I spent like a good 15 minutes crying in my car.. 

 

Mine was when I was under 18... so asking the police department or municipal courts wouldn’t really help my situation. Tomorrow I’m going back and try to see another department and see if they can help me. 

 

My lawyer has has been no help at all. I couldn’t even get him personally on the phone and I had to demand a meeting with him tomorrow. 

 

Honestly this has been a huge nightmare, I’m terrified of not sending back right thing because that blue paper we both weren’t expecting says something along the lines of failure to admitting all evidence may result in denial. I’m also terrified of how much long we’ll have to wait for a NOA2 approval... 

 

Thank you for sharing your story. And I’m so sorry you also got an RFE, I’m feeling everything you’re feeling now too...

Well now I do too.... 

 

I honestly don’t know what to tell my fiancé of when he will be here with me. And they breaks my heart... there’s no way of knowing when I’ll get my stuff for the RFE and when I send it back and when USCIS will look at it and get an approval then the NOA2 Is not even the last step. Aghhhh it’s so draining...and depressing.

I think you misunderstood me. I am saying it is a blessing that strangers on this forum are helpful. Without them I would know nothing! My reason for saying that is, this government agency should not leave us in the dark for us to fend for ourselves on here and should be giving us answers/updates. I'm optimistic and realistic. Sometimes it's hard to make any sense or realize why we have to go through this. I so hope that this process gets better for future applicants!

Have you had the chance to travel around/explore while living in Japan? I find most of my friends that work in Japan (teaching English) are so busy and broke, they don't get to do anything fun :(. Last year I went to Gifu prefecture and I loved it so much! I wanna go back right now.

 

The US job market is a lot like USCIS I think. The wild west. Easy come, easy go. Who knows what to expect 😂 No job security is a blessing and curse. It's much easier to get a full time job because an employer can fire you if they want so it's less of commitment (whereas in countries where it's impossible to fire someone it seems it's very difficult to get a steady gig), but on the flip side it's head to ever feel safe... I'm not sure which is better!
