If I were you, I wld get a waiver attorney. Just give her this letter and they ll know if u also have to complete the 212. But you will definely need the i601 waiver.

 

Things are so tricky these days, just to be on the safe side. Good luck.

You have to check on that case very well maybe the recieved date might be early and maybe they were asked to bring some documents or asked to do something which will make their date change to current but whiles the uscis dealing with the case they can deal with it early than case which were recieved even them same date so on the app you add that case and open to check well ok that case steps

For example this case you see the first date at the buttom that is the recieved date and you see the date at the top that is the level the case was currently at so if you on the app you wont see the date at the buttom for this but you will see the date at the top so if its approved then a case of the same date is not it doesnt mean they are working pass so cases but it is the reason of this case being there for long i hope you understand

I-601 waiver is require only if yo have prior deportations and you have to complete for this prior deportation time 3,5, or 10 years . But will be better if you hire a lawyer for advise, every case is different.

My spouse was for unlawful presence according to the embassy because she could not provide she had a valid visa. She was given a 10yrs ban after her interview but we only filed an I-601 which has been approved.

 

Case update....

After approval my spouse went to the embassy last week with police report, medical report and online submission of DS260. The embassy requested another AOS from me which she has submitted. I guess because i was unemployed when i submitted the last AOS on file. Days after submission they called my spouse to come with passport for new biometrics. Current issue is that the embassy says they are having system issues printing her visa. So all she is waiting for now is for the embassy to correct their system issue on her case and print her visa and she will be on her way to the U.S

Hi, please when did you file your waiver, which Poe was he deported from and also have you got your waiver approved?
