Minor error on conditional green card....to correct or not to correct?

Hi everyone!

 

We finally got the GC in the mail surprizingly fast, about a month after POE. The problem is, under my husband's first name, it has his FIRST and MIDDLE name together as one line on the front of the card, and because of this, the two last letters of his middle/patronymic name are cut off.

 

We went to the local USCIS today here and they said the issue looks like that they listed his first and middle name together on the "first name" line and the "middle name" line was actually left blank in the system. She told us that all we could do is basically send in an I-90 for a replacement card but that it would it take up to 9 months to get a new GC in the mail.... Weirdly enough, on the back of the card, his middle name is listed in full without the letters cut off.

 

I'm wondering, what if we just waited until ROC to correct this and just kept the faulty GC? Would this be a problem later? Would we then just attach a cover letter with the ROC package explaining the situation with the mistake? Or would it be better to go ahead and send in the I-90 right now and wait?

 

Would appreciate any feedback from anyone else in a similar situation. Thanks so much guys! We asked the same questions to the USCIS worker but she seemed unclear as to what the best option would be herself.

hi -  i don't have personal experience but on reading this from an outsider's perspective, seems like the best option, if i was in your shoes, would be to order the corrected replacement card anyway? just so you are on the safe side. even if you wait for the card for up to 9 months, at least you have proof that you were proactive in getting it corrected and you can hold on or keep the current card in the interim. just my two cents...

If you send the card back (which I would probably do), first make multiple copies of it, front & back, to keep.  The immigrant should keep a copy of this card and a copy of your cover-letter to USCIS ("enclosed is the green card for reissue because of USCIS's error...") until the new card comes.

Wanted to update this thread with a follow-up post.

 

My husband and I decided to submit the I-90 online just to avoid the whole mail-in mess. We went through the process and USCIS scheduled him for a biometrics appointment at the local office here. He went over there and everything went really well. Filing online was also very smooth and easy. I highly recommend this for anyone else who needs to do an I-90!

 

They told us to wait for the replacement (corrected) via within a one year time frame. The best part was, they told him just to keep his old card in the meantime! That was a huge relief because I thought we would have to send it back with the I-90. So, it appears that if you do your I-90 online, you can keep your old card while you're waiting for the replacement one (if it's a USCIS error).

 

Very pleased with the experience. The local USCIS office here is the best.

I'm glad it all worked out. Did you have to pay the replacement fee since it was USCIS' error? 

 

I did a replacement via I-90 too however I mailed it in. I was also able to keep my previous card without any issues

Nope, because it was a USCIS error we did not have to pay anything.
