My spouse attended an interview and was told by the consular that the petitioner did not declare she was divorced in the application and therefore the case will be sent to uscis for review,and that the case will take up to 6months before it's sent to uscis.So 6months time I had a notification from uscis that they have received the case and that it will take 180 days for the review.iys been more than 189dayd now and have called to find out but still have not heard anything.what do you recommend I do at this point.

you can ask your petitioner to contact the senator or congressman to contact the uscis on your behalf. But in all of that you must know they can't change the outcome nor speed up the process. You can only wait at this time because I feel throughout the process, the uscis is the most effective of all the departments. Hang on soon they will send you noir or reaffirmed without noir. All you should be doing now is collecting evidence to rebut any findings from the embassy in the noir if you ever receive one. All the best.

Mine took 12 months from the date USCIS received my case till the date it was reaffirmed.

Interview: 10/26/2015

USCIS received case: 3/10/2016

I received my NOID on 6/5/2017

I sent more evidence on 6/9/2017

Case reaffirmed on 7/11/2017.

 

My advice is that, gather more evidence base on the questions they asked during the interview. In my case, I asked my wife to write all the questions they asked her during the interview and how she responded to them. This helped me to write my rebuttal letter.
