Will you be moving back to the USA at the same time or before your mother? The purpose of the visa is family reunification, so you would need to live in the US, too. You can't petition for somebody to live in the US and remain living abroad.

 

If so, you can apply from Mexico fine. You will need to provide an I-864 for her (and use a joint sponsor if your income does not qualify or is insufficient).

At the same time, then there is not problem if a set my directions of Mexico in the form?

It's not a problem for you to apply from Mexico. You will (eventually) need to show US domicile or intent to establish US domicile, and enter the US before her or at the same time as her (and live there!).

 

For the I-864 (Affidavit of Support), only income that will continue from the same source after returning to the US will qualify. So in most cases, a Mexico-based job will not qualify. You can use a joint sponsor to meet the financial requirements. The joint sponsor must be a US citizen or green card holder based in the US.

Consulates vary as to how much they want to see you in the US, when are you heading back home?

 

Did her Brothers petition for her?

thanks, the Affidavit is going to be my unclue, I need to added to the first package? or wait until they request me?

I want go back at the same time with her; no they not petition because take long time.

By the time she attends her interview, you must have gathered enough evidence to show that you are establishing your residency in the USA either before or at the same time as she is. 

You will be the petitioner and primary sponsor and must complete the I864, even though you will not meet the financial guidelines. Your uncle will be the joint sponsor and he will complete his own I864 

thnks, the form I864 must be sent on the first package, or until USCIS make the request?
