I dont know what gets me thinking of these things ....

A PHP requires you to be a resident of the province UNLESS you're going to be out of Canada temporarily......

the temporary absences are;

study

work

missionary work

vacation/other

......and its the "other" that has me wondering

NOW......OHIP says "Ministry of Health and Long-Term Care may continue your eligibility for Ontario health (OHIP) coverage when you are absent from Ontario for more than 212 days in a 12 month period, as long as you plan to return and make your permanent and principal home in Ontario."

When one arrives in the US on a k-1 or k-3 obviously the intent is to not return to Canada any time soon .....HOWEVER.....if CR/LPR status is denied, then you do plan to return as you wouldnt have any other choice. So could "other" possibly be " contingent on CR/LPR status". Technically without USCIS approval you aren't legally or officially a resident of the US you're technically a visitor.

Like I said ......i dont know what makes me think of these things ......maybe I shoulda been a lawyer  as Im always trying to find the loophole. My husband doesnt even have a PHP and wont ever use one....

lol, I was goin gto say, he probably doesnt even have a PHP, because he is military!! lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

However, you plan to apply for permanent residency in the US, so no, you are not eligible to keep Canadian provincial health care, unless you definitely have an expected return date. Like TN visas do.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

Does that work the opposite way? I mean, if one were to temporarily reside in Canada for a few years, could they retain their American health insurance if they intend on returning?

Depends on your employer... some employers make some sort of provision to have health insurance in the US for cases like surgeries, etc to get people to overcome their apprehensions about the Canadian Health system...

You are just a fountain of knowledge, Zyggy! :D

I don't get my health insurance through an employer. I pay for it myself. I've got a PPO plan through BlueCross BlueShield of Texas.

omg Flames , you shoulda been with us one day. He had surgery on his shoulder and was recovering in Michigan. His Blue Cross wouldnt cover physio in Michigan so we had to drive to Sarnia. Well he was due to have his stitches removed and needed a wound check so while in Sarnia we popped into a clinic.......he gets to the desk and woman asks for his health card , he says " i dont have one" she says well i cant treat you w/out one" he says I'm in the military I dont have OHIP" she says well "I cant take you, go to the Ministry of Health and get a health card" So we go to the MoH they say " nope you're not entitled to a PhP" he went around and around with the woman and walked out empti-handed. We ended up having to sit in the ER.....he was livid. Having come from a military family and being military all his adult life , he has no concept of waiting.......no concept of the term " not covered".......

anyway.....

they said you would be covered for emergency treatment in the US up to 7 months or until you obtain PR status in the US.

So is "PR status" considered when you file AOS? Once it's granted on a conditonial basis? Or once you get the 10 year green card? Still good info to know. My fiance won't be convered under my health plan until we are married, which may be two months after she enters the country.
