Hello everyone. I got my CR1 visa approved last week. However I can't leave for USA yet, because of my job in China.  I have 2 questions need your help:

 

  1. I am going to enter USA in November before my CR1 visa expires, and will stay with my husband for 1 week then go back to China again. But I am pretty sure I wont receive my green card by then, so I am wondering whether it is OK to leave without green card? 
  2. Also, if i stay in China for 3 months, it will be OK? I am thinking to ask my husband to mail me the green card when he receives it. Thus,  I should enter USA with green card in 3 months, or I can only use the CR1 visa with CBP stamp? As I heard that the visa with stamp is a temporary green card.

Your plan will work fine, with or without the green card upon re-entry.  It usually takes at least 3 weeks to receive the green card.  Be sure your husband uses DHL, FedEX or Global Express Mail from USPS, to send the card, if you insist on doing it that way.  Frankly, I would not have him send it at all.  The combination of stamp and visa ARE a temporary green card.  If asked, just indicate, your husband awaits you with green card in hand.  You could even have a photo of it stored on your phone.  Losing it is very troublesome.

Facts are cheap...knowing how to use them is precious...

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!

July 26, 2011: Received NOA2 via text/email!!!

August 8, 2011: NVC received file

September 2, 2011: AOS invoice received, OPTIN email for EP sent

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Technically you can travel with the stamp, you won't have any problems at the US border, however a number of people have reported problems with some airline personnel not understanding it and not wanting to let people board, so would advise you take a copy of the relevant page (I think its page 40 iirc) from the CBP manual for airline carriers.

 

if your husband sends you the card do it by courier only. If the card gets lost, bear in mind that not oniy will you be responsible for the cost of a new one but (as we have just discovered) currently the wait time for a replacement green card is about 11 months. That would take you past the validity period of your stamp.

Thanks for your reply! But what's page 40 iirc anyway? For the airline personnel, it would be better if I can show them with a green card?
