I have a quick question to anybody that knows the answer. I am 62 years young and have met a 24 year old Morrocan woman via Facebook. We have chatted for 3 months and I intend to visit her in another 6 months. After that if everything goes well, I intend to file a K1 fiancée visa. My question: does age difference matter for acceptance for a k1 visa.  Much appreciated for your answers.

Quick answer: Nope!

 

As you are both legally able to marry, your age is not a factor.

 

You might get a tiny little bit more scrutiny when it comes to the immigration process down the road, with proving an on-going relationship, and that the relationship is bonafide. and so forth though. The age difference has to raise red flags for fraud, as you can probably imagine as you're asking this, but as long as everything's hunky dory, you'll have absolutely nothing to fear or worry about! Gather lots of evidence of an on-going relationship whenever you both are together, and save it for when and if someone might ask.

It is a red flag......your relationship will receive some scrutiny.  But USCIS will evaluate the totality of your relationship.  Face time together will be very important in your case.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you my brother. That's what another person has said. What if I visit her in Morocco  the next  six months, and then she visits me when I move  to Vegas  and we get married in Vegas.  Does it give more  credibility that we love each other. Although i went to a Baptist  college, I don't have any church affiliations. Hope  for  a better answer from you sir.  Regards

Sure, you can visit her. That can be used as proof that you have met within the last 2 years preceding the I-129F filing date. However, Morocco is a high fraud country therefore it is advisable to meet more than once. It doesn't have to be Morocco alone. You can meet in a third country. 

 

She can try for a B2 tourist visa but she will only be granted one based on her own merits. She needs to be able to prove her strong ties back in Morocco. Failing to do so, she will be denied a B2 tourist visa to visit you anywhere within the US. So, again, think meeting in a third country if not Morocco.

 

Please note that entering the US with a B2 to get married is visa fraud.

 

If you want to get married and then file a petition for her, you can consider a I-130 for a CR-1 spousal visa instead. Still, you'll need to be able to prove a bonafide marriage.

 

Love alone is not enough for immigration. You'll need to be able to prove everything is legit to USCIS and the local embassy. You just chatted with her for 3 months, why the hurry?

Thank you for your response. Much appreciated. I just plan ahead. Going to visit her within the next six months and spend about 10 days  in Morocco. Her family lives  there, I intend  to visit her a couple of times and the file the k1 in about 1 1/2 from now. As I read correctly, it may take up to 180 days  for an interview. Btw, I am not getting younger, I am 62. Thank you  friend for the advisory on marriage before the k1 petition. Thank you again

Advancing age, unfortunately isn't taken into consideration. What matters is proof of bonafide relationship or marriage. USCIS and the local embassy want to make sure intending immigrants enter into a relationship or marriage with an American citizen in good faith and not using the American citizen for the sake of obtaining permanent residence or citizenship.

 

Currently, it takes closer to 4 months for a I-129F to be approved by USCIS. Thereafter, the case file would change hands between USCIS, NVC and the local embassy whereby it could take as little as 2 weeks up to a month or more. After the local embassy receives the file, they might take a few days to a few weeks to contact the alien beneficiary with Packet 3. Depending on how fast the alien beneficiary would take to gather all required documents get the medical done as well as interview slot availability, it may be 30 days or more (2 or 3 months) before the alien beneficiary gets interviewed and the visa application is approved or denied. All in all, a straightforward case will take between 6-8 months in total. However, RFE, backlog at USCIS, speed of USCIS adjudicator and long AP will add on extra time to the standard processing times. Given that she's from Morocco, the petition by you and her visa application may face a more serious scrutiny.

Thank sir for the elaborate explanation. It will be  a good two  years before she can come here via the k1.  I intend to make  a couple of trips with  extended stays of a week or longer. This should satisfy  most of the bona fide  requirements, and of course I will a boatload of paper trails like hotel receipts, air fair tickets purchased and destinations,etc.  Why you may ask I have to go overseas for  love? Could not find local (USA)  love here, so we found each other. Thanks again, I know now how to proceed.  I may have  to ask you about the I-129f when that time comes. Going to have to share my lottery winnings with you sir. Have a great night.

Most of us here found love overseas, thanks to the internet! No one's judging you for that. Just letting you know how it works and what to expect. It's not gonna be easy but it will be worth it if the relationship is real and people truly love one another. All the best ;)

Thanks again for everybody that help me today. She is young and pretty, and we share  the love. Not in a million years if you ask me 6 months  ago that I would go overseas for love. Thanks guys, will let you all the  good news  in two years.  God bless.

Not quite. Getting married is fine. Getting married with intent to stay/adjust is fraud. CBP determines this intent at POE.
