2018 dv winner but im getting divorced how shall i fill ds260

hi

i won the DV2018 lottery Im from Algeria iam about to fill the sd260 form but i get one problem im getting divorce from my husband well during the registration in the lottery i mentioned that iam married but now what shall i do knowing that i have a 7years old son and im bringing him with me without the father 

so plz if anybody here has experienced this sitruation help plzz

Just fill in  DS260 forms for yourself and your son. (If your divorce is not yet finalized it might be better to wait till it is before filling in so that you can legitimately leave your husband off the list of derivatives on your DS260, although in any case there is nothing that says a derivative has to accompany you so it shouldn't matter either way.) You'll need to bring a copy of the divorce papers to the interview as well as custody documents showing you are allowed to remove your son from the country you live in.

When you fill the DS-260 you still need to list him as your husband and the father of your son. If he will not be emigrating with you you should not fill a DS-260 for him. Once your divorce is finalized you can send the divorce decree to NVC or take it the embassy if your interview is scheduled. You will need to have a court decree to prove you have custody of your son or a letter from your husband stating that he does not object you taking him with you.

NVC has nothing to do with the DV process. Susie already gave an excellent response to the OP.

I meant KCC not NVC.  I didn't dispute SuzieQQQ, I just added to what she said.

KCC specifically tell applicants not to send them any documents. I'm assuming you didn't go through DV....

I did I won the DV2015 lottery. I was very active in another forum. I was the pregnant mommy from AF whose husband had a scar in his lungs and I was rejected even though I was the principal, you guys encouraged me to dispute it. I know you're the experts. I am only saying what I learnt. From my experience, if you have time, you can ask them to unlock your DS-260 if you have a child or divorce etc and they need to see proof like a birth certificate or a marriage certificate.

Yes, and we already answered before that they need to take the divorce certificate and custody documentation to the interview. See post #2.
