Hello everyone,

 

As the title suggests I'm a male applicant who married a US citizen woman. Since most applicants are women I did not find any answers to my questions.

When we got married my full name remained the same while she changed her last name to mine.

  • In AOS, EAD, AP, Affidavit form whenever I have to write her name, I wrote it with my last name. Correct? No?
  • I don't know if the USCIS need it but we included copies of her passport, birth certificate, etc all with her old full name because we did not yet go to change all those documents. Correct? No?

I think that since I'm the one applying for these forms it would not matter as long as we are married. All other documents comes later once we filed all these things.

All information is appreciated because we already delayed a lot due to these stuff.

You are correct, it doesn't matter. She can start using your name when she wants to. You are sending the marriage certificate and that legally ties together her new name and the name on her documents.

Yes you can use your last name on the AOS as her last name if she wishes to take your last name, the marriage certificate is sufficient for the name change.
Later she can change her passport, DL etc.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

We started filling out our paperwork the day we got married and even though I hadn't actually done anything to change my name yet, we still filled out the forms with what would be my new name. I sent a copy of my temporary drivers license with my new name as soon as I changed it about a week later. I still haven't changed my passport because it's expensive and we aren't going to travel out of the country for probably a couple years. No big deal, everything is (so far) going smoothly.
