K3 Visa Administrative closed...means i130 approval????

Hello,  

 

I know most don't file a k3 anymore but I wanted to hopefully increase any chance of my husband coming home sooner so I did it anyway.  So today I was checking my case statuses.  My I130 is still no update but the k3 says administrative closed due to beneficiary receiving benefit from other means.  Could this mean my i130 is approved?  I thought it would become void once my case hit the NVS..

 

Does anyone know....I'm so hopeful!

No.. It simply means the K3 has been cancelled&your husband is only on the CR1 process.

It means that it will not proceed as a K3 and your husband's case will just be treated as a CR1 instead. If there is no update to the I-130 then it means that there is no approval nor denial yet. You will have to wait until the I-130 is processed now. This is usual as K3's are rarely approved anymore and are simply converted to a CR1.

I have not seen USCIS administratively close an I-129F properly filed in behalf of a spouse.  Some more facts about the timing of the two filings and whether you included the receipt notice for the I-130 in your I-129F package, might help clear things up.  Either way, there's clearly not going to be a K3 case.

Facts are cheap...knowing how to use them is precious...

Thanks for the reply!!    I did supply my receipt from the i130 so I just had a feeling that after 4months of them receiving the i129F  that they were closing it because the i130 was approved.  Everything that I read said that the k3 would be closed once its reaches the NVC but was confused because I have not heard anything about my i130 case....Sooo I just got off the phone with a tier2 officer. ..my i130 was approved yesterday !!  They just have not updated the site!  I'm so excited!!!

I've seen it happen a few times over the past several months back when I ran daily scans. The exact wording was: "Your Current Status: Case Closed Benefit Received By Other Means", followed shortly by the corresponding I-130 being adjudicated (at least according to the couple K-3 filers in the monthly I-129F threads).

 

Otherwise, the I-129F is approved, then shortly closed by NVC.

That makes it sound like USCIS has decided to cut off the K3 themselves instead of leaving it up to the Dept. of State (NVC) to do.  The result would be identical.
